The collision occurred around 2:15 in the morning on Tuolumne Road in Sonora, west of Industrial Way.

The driver, 32-year-old Columbia resident Kristopher B., was traveling east in a 2004 Chevrolet pickup truck at about 35 mph.

According to the CHP, he permitted his car to veer off the road, crash into an embankment, and then strike a wooden post.

Ballard and his passenger, Samaripa, 32, were only slightly injured in the collision.

A CHP officer who arrived on the scene found Ballard exhibiting signs and symptoms of intoxication.

He handcuffed Ballard after determining that he was operating a vehicle while intoxicated.

Ballard was taken into custody for felony DUI with great bodily harm potential.
