Premises Liability Laws in California

Whether it is for commercial or residential use, a property owner has a responsibility to protect the safety of visitors and customers. Negligence occurs when a property owner fails to keep their property in a safe condition.

If someone is hurt in a fire or explosion caused by a dangerous or hazardous situation on someone else’s property, the property owner or operator may be held liable.

According to the National Fire Protection Association, home heating, electrical distribution, and lighting are all key causes of house fires. Life-changing injuries can result from flames, in addition to the property damage they cause.

If a fire results in an injury or death, the property owner where the fire started may be held liable for negligence. You might file a premises responsibility claim if this is true.

Premises Liability Attorneys for Victims in Los Angeles County

If a property owner fails to find a hazard that they should have discovered, fails to fix a known hazard, or fails to warn of a known hazard, they have breached the duty of care due to individuals who enter the property.

Assuming the plaintiff can prove these two prongs, as well as causation–that their injuries would not have occurred if the property owner had not breached their duty of care–they will have a strong premises liability claim against the property owner.
