What to Do After a Premises Liability Accident

If you are injured on someone else’s property, you must take swift action to protect your right to financial compensation. Immediately following an accident, you should inform the property owner so that they can begin processing your claim for damages. Get a copy of the report after filing a written complaint with the property owner, manager, supervisor, etc.

If you can do so at the time of your injury, it is best to collect any evidence there that may be helpful. Photographs of the hazardous area, witness contact information, and a detailed account of what you did during the incident should all be included. Having more evidence makes it simpler to prove your argument.

If you do not get checked out immediately, you may have difficulty showing that your injuries are due to the accident on another person’s property. In addition to bettering your chances of recovery, medical care is also vital evidence in a premises liability claim.

Property owners and their insurers are not keen to pay out settlements if compelled to, so don’t count on getting one just because you sought medical attention and filed a report of the incident. You can increase your chances of getting the settlement money you are owed by working with a premises liability attorney.

The owner is liable for fixing any apparent dangers on the premises and posting warnings when rapid repairs are impossible. The duty of care due to persons who enter a property is infringed if the owner fails to find a hazard that they reasonably should have, rectify a known hazard, or provide a warning of a known hazard.

Suppose the plaintiff can prove these elements and causation (that the defendant’s violation of the duty of care directly caused the plaintiff’s injuries). In that case, they will have a strong case against the property owner under the doctrine of premises responsibility.
