Make sure that law enforcement arrives at the scene and files a report. During an interview at the scene of an accident, be honest about what you saw and experienced. Use your words carefully and avoid making assumptions about things you don’t understand. Immediately following an accident, victims may apologize profusely, even when not at fault. This act of kindness can be twisted into evidence that you admitted guilt by your insurance company to avoid paying out.
