Bicycle Crash Statistics
Both drivers and cyclists have a responsibility to follow traffic laws. These regulations include but are not limited to traffic laws and the requirement to use common sense when it comes to one’s and other people’s safety on the roads.
According to the National Highway Traffic Safety Administration (NHTSA), cyclist fatalities reached a ten-year high of 871 in 2018, with estimates for 2019 showing 846 deaths.
Many of these incidents occurred because the driver failed to yield the right of way, failed to check for bikes before pulling out, ran a stop sign or red light, or was otherwise distracted while driving. Drunk driving, texting and driving, and careless driving can all result in a bicycle collision.
Avoiding a collision is not always possible when a driver acts negligently or recklessly. Don’t put off speaking with an attorney after an accident. Whatever the extent of your injuries, you have the right to speak with an experienced personal injury lawyer about your compensation options. You should be able to recover compensation for your medical bills, pain and suffering, property damage, and other expenses.
Kern County Bicycle Accident Lawyers
Bicycle accidents can result in serious injuries and large liabilities. Bicycle accident lawsuits frequently concern whether the driver or the cyclist was negligent in causing or contributing to the accident. This negligence determination can be difficult and time-consuming.
To succeed in a lawsuit alleging another party’s negligence, the victim typically must prove that the defendant’s actions breached a duty owed to the plaintiff. This means failing to exercise the minimum degree of care owed to other people while operating a motor vehicle or in the vicinity of a roadway, which is the basis for liability in auto accident cases.
Many personal injury cases are decided by the testimony of witnesses to the incident and other pieces of circumstantial evidence that can be used to establish the defendant’s negligence.
