A 24-year-old woman identified only as Caroline was seriously injured during the Coachella Music and Arts Festival inside the popular Sahara Tent after being struck by a falling balloon prop. Kristin, who came forward on Reddit, as a friend of Caroline, said that she was dancing near the rear of the tent when the incident happened. Caroline was knocked unconscious after the accident and sustained a traumatic brain injury. This accident comes right after someone else died at the Empire Polo Grounds, a week before week one of Coachella. There’s an ongoing investigation underway, looking into how the balloon-like stage prop came unhinged. Caroline’s family is asking anyone that may have information about the injury to reach out to News Channel 3 reporters, or directly to our office.

The Extent of Liability in These Types of Cases

Festival organizers have a legal responsibility to take precaution to make sure that their property is reasonably safe. According to the California Civil Code § 1714 Section (a):

“Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself. “

This includes making sure guests are not struck by hanging objects. There are several sources of potential negligence if a guest is hit by a falling object such as:

  • Subcontractor errors
  • Faulty tools or machinery
  • Bad weather or protection against it
  • OSHA-related work violations
  • Improperly secured bolts, screws or hinges

Victims that are struck by falling objects can suffer traumatic brain injuries. According to the Mayo Clinic, “Traumatic brain injury can have wide-ranging physical and psychological outcomes. Some signs or symptoms may appear immediately after the traumatic event, while others may appear days or weeks later.” Even victims that produce a complete physical recovery can be left with ongoing psychological ailments including post-traumatic stress disorder.

Typical symptoms of PTSD include:

  • Unwanted flashbacks of the traumatic experience
  • Avoidance of people, places, sights, and sounds that are reminders of the event
  • Hyper-vigilance and constant alertness of risks
  • Feelings of detachment from people and emotional numbness

According to one study from Northwestern University, the lifetime costs associated with treating a severe brain injury can reach as high as $3,000,000. Any person that is injured due to the negligence of festival organizers might have the ability to pursue an injury claim for damages.

Damages can include money for lost wages, medical bills plus pain and suffering.
