A 61-year-old woman identified as Kyu C. became a victim of a tragic DUI accident last month, September 27.

[09-27-2021] Orange County, CA - 61-Year-Old Woman Dead After DUI Crash at Sand Canyon Road and Irvine Center DriveLocal authorities report 21-year old Luis Marcial D. has been charged on October 14, Thursday, with murder for driving under the influence of drugs after a deadly collision last month, September 27, at Sand Canyon Road and Irvine Center Drive at 4:00 am resulting in the death of Kyu C.

According to Kimberly Edds, a spokeswoman for the Orange County District Attorney’s Office, Kyu C., of Irvine, was driving to work in a Prius when she was struck by a Mercedes-Benz driven by Luis Marcial D., also of Irvine. Diaz is accused of speeding and broadsiding Chen’s vehicle. Diaz was arrested for DUI in Huntington Beach on July 30, 2019, according to Edds.

In California, drivers arrested for DUI are given a Watson warning, which states that if they kill someone while driving under the influence of drugs or alcohol, they will be charged with murder. Orange County District Attorney Todd Spitzer issued a statement saying, “This is a tragedy that should have never happened.” “Just hours before Mrs. Chen was murdered, doctors managed to save the defendant from overdosing on drugs.

Instead of taking that near-death experience to heart, he continued to engage in incredibly dangerous behavior, and it cost Mrs. Chen her life.” It has yet to be determined how Diaz used drugs in between the hospital departure and the crash.  He was arrested right after the crash, but Edds said he was released while Irvine police investigated the cause of the crash. Diaz was arrested again on Tuesday and was held in custody on a bail of more than $1 million. Diaz now faces imprisonment of up to 15 years if convicted of charges.
