Fatal Pedestrian Accident Statistics
Pedestrian accidents frequently result in serious injury or even death. Unlike passengers in private vehicles and motorcycle riders, pedestrians are not protected from fatal accidents. According to the National Highway Traffic Safety Administration (NHTSA), over 5900 pedestrians were killed in the United States in 2016.
Walking anywhere in California is dangerous. Locals would tell you to be extra careful when walking along the road as it’s not rare to encounter a reckless driver. This is a sad reality that locals have to deal with.
California’s pedestrian fatality rate is 25% higher than the national average. In 2018 alone, 14,000 pedestrians were injured, while 893 were killed. Nearly 7,500 pedestrians have died in California between 2009 and 2018. Some common reasons pedestrian accidents occur are negligent driving, speeding, and drivers failing to yield to pedestrians.
Santa Clara County Wrongful Death Attorney for Victims of Fatal Pedestrian Accidents
A pedestrian accident can happen in the blink of an eye. It is hard to accept a death of a loved one when the negligence of another motorist causes it. The victim’s family has the right to hold the negligent party liable. They can receive compensation for the damages through a wrongful death claim.
The wrongful death claim will allow them to receive compensation for the hospital bills, lost wages, funeral costs, and pain and suffering that they’ve endured due to the accident. However, there is a limit to how long the victim’s family can file a claim. A California wrongful death lawsuit must also be brought within two years of the date of the accident. A family member is precluded from bringing a wrongful death lawsuit if it is not filed within that time period.
