Product Liability Accident Statistics

You may be entitled to compensation from the manufacturer or distributor if a product’s flaw or malfunction results in your injuries.

The United States Consumer Products Safety Commission (CPSC) keeps track of product-related injuries and fatality trends. However, each product liability case has its own unique set of circumstances and unfortunate outcomes. They disclosed the following data:

Product liability claims comprised 7% of all personal injury lawsuits in 2004.

With a median damage award of $300,000, product liability cases have the second-highest median damage awards of any personal injury cases.

In these situations, you do not need to show that the defendant was negligent, but you do need to demonstrate that the product was unreasonably dangerous and that a flaw caused your injuries. Although there are countless variations of product defects, the law classifies like into this category:

  • Manufacture error. Other times, a product’s design is safe, but manufacturing, assembling, or distribution error renders it unsafe. A water heater that has a part missing, for instance, makes the appliance susceptible to exploding while in use. Another illustration is a batch of drugs that accidentally become contaminated with a foreign substance while being produced.

You might still be entitled to compensation even if the item that caused your injuries is on a recall list. Not all manufacturers are immediately liable for damages because they recall a product. In California, a voluntary recall does not shield the business from legal action. Still, the injured party must have all the necessary proof to prove product liability.

If the courts permit, a product recall may be used as proof of the product’s flaw. So far as the consumer should have been aware of the product’s shortcomings, the manufacturer may use a recall as a defense, but only if it can demonstrate that the plaintiff was given direct notice of the recall.
