What Los Angeles Injury Victims Need To Know First
- Which agency wrote your report changes how you get it. The Los Angeles Police Department handles collisions on city surface streets. The California Highway Patrol handles freeway collisions, including the 5, the 10, the 101, the 110, and the 405. The Los Angeles County Sheriff’s Department covers unincorporated county areas and contract cities. LAPD releases Traffic Collision Reports to authorised parties online or by mail through its Records and Identification Division, and advises allowing at least 45 days from the collision date. Reports involving an arrest, a fatality, or a juvenile are available by mail only.
- If a public entity may share fault, a separate and much shorter process applies. Claims against the City of Los Angeles are filed with the Los Angeles City Clerk’s Claims Department at 200 North Spring Street, Room 395. No other office can accept them. Claims against the County of Los Angeles go to the Executive Officer of the Board of Supervisors at 500 West Temple Street, Room 383. For death or injury to a person, California law requires presentation within six months of accrual.
- Metro and Caltrans are their own defendants. If a Metro bus or rail vehicle was involved, or if a condition on a Caltrans-maintained freeway may have contributed, the claim runs through that agency’s own presentation process, not through the at-fault driver’s insurer alone. Identifying the right public entity early is what protects the claim.
- Some Los Angeles evidence disappears in weeks, not years. Private security footage from businesses along corridors like Wilshire, Figueroa, Vermont, and Sepulveda is commonly overwritten on a short cycle. Signal timing records, roadway maintenance histories, and commercial vehicle telematics all have retention limits. A preservation demand sent early is often the difference between proving a condition and arguing about it.
- Where your case gets filed depends on where you were hurt. Since October 2022, Los Angeles County Superior Court requires personal injury cases to be filed in the judicial district where the incident arose. Cases filed in the Central District are assigned for all purposes to Independent Calendar departments at the Stanley Mosk Courthouse at 111 North Hill Street. The court publishes a filing court locator to identify the correct location.
- The scale is not abstract. In 2023, California Office of Traffic Safety rankings recorded 58,758 people killed or injured in Los Angeles County traffic collisions, 4,034 of them pedestrians.
