Steps To Take After A Fatal DUI Crash

Losing a loved one in a crash involving a suspected impaired driver can be overwhelming. In addition to the emotional toll, families are often left with urgent decisions and a need for information. While every situation is different, the steps below may help guide you through the immediate aftermath.

  1. Stay In Contact With Investigators
Crashes involving suspected DUI are often handled by local law enforcement and may include a criminal investigation. You can reach out to the California Highway Patrol or the agency in charge to request updates and ask how to obtain a copy of the official report.
  2. Request the Coronerโ€™s Report
The county coroner or medical examiner may issue documentation that explains the cause of death. This report may be helpful for insurance claims or other formal matters.
  3. Gather And Save Any Related Information
If you have access to photos, personal items from the scene, witness contact details, or news coverage, keep them organized and secure. These materials may be relevant later.
  4. Track Any Related Costs
Funeral expenses, emergency services, and other out-of-pocket costs can accumulate quickly. Keeping receipts and a record of payments may help you understand the financial impact.
  5. Avoid Early Contact With Insurance Companies
You may be contacted by the at-fault driverโ€™s insurance provider. Before making any statements or accepting a settlement, it may help to speak with an attorney to avoid decisions that could affect your options.
  6. Speak With A Lawyer Experienced In DUI Accident Victim Cases
An attorney can help explain what rights may apply and whether compensation could be available. Legal guidance may also help you understand how civil claims relate to criminal proceedings in DUI cases.
