Duarte Car Accident Attorneys

If you were hurt in a crash on the I-210 Foothill Freeway or on Huntington Drive in Duarte, you may have a car accident claim if another person or entity caused or contributed to the crash. California law allows you to seek compensation for medical expenses, lost income, property damage, and other losses.

California Office of Traffic Safety (OTS) data for 2023 recorded 50 people killed or injured in traffic collisions in Duarte. The city has roads like Huntington Drive, Buena Vista Street, and Duarte Road that can bring drivers into contact with turning vehicles, pedestrians, and cyclists. Furthermore, intersections, driveways, and nearby I-210 ramps may create conflicts as drivers turn, merge, or change lanes.

Arash Law represents people injured in Duarte car accidents from the initial claim through settlement or litigation. If you were injured in a crash, we can help you hold the at-fault driver accountable and gather key evidence.

Who Can File a Car Accident Claim in Duarte?

You may have a car accident claim if another person or entity caused or contributed to your injuries. Under California law, who can bring a claim depends on who was hurt, how the crash happened, and who may be legally responsible.

Injured Drivers
If another driver caused or contributed to your car accident on a Duarte road, you may be able to file a compensation claim.
Passengers

Passengers may bring claims against any driver whose negligence contributed to the crash, including the driver of the vehicle they were riding in. For example, a passenger injured in a multi-vehicle crash on the I-210 near the Buena Vista Street exit may have claims against one or more drivers, depending on how the crash occurred. A passenger’s own conduct may also be considered if it contributed to the accident or injuries.

Pedestrians

A pedestrian struck on Huntington Drive or at another Duarte intersection may have a claim against the driver or another party whose negligence contributed to the collision.

Bicyclists
A bicyclist injured on a Duarte street may bring a claim under the same general negligence rules that apply to other road users. The evidence and parties involved will depend on where and how the collision happened.
Wrongful Death Claimants
When a Duarte crash is fatal, California law allows certain family members and dependents to bring a wrongful death claim. These may include a surviving spouse or registered domestic partner, children, certain descendants, and other qualifying relatives or dependents under California Code of Civil Procedure (CCP §377.60).

The deceased person’s personal representative or, if none, their successor in interest, may pursue claims that survive the person’s death under CCP §377.30. A survival action seeks compensation for losses the deceased person suffered before death, such as medical expenses and lost income. It is separate from a wrongful death claim, which addresses losses to eligible family members.

Once the proper claimant is identified, the next step is to determine who may be responsible for the crash and what evidence from the Duarte area can support the claim.

Why Duarte Car Accident Cases Are Different

Duarte car accident claims follow the same California negligence and comparative fault rules as claims in other parts of the state. What can make a Duarte case different is where the crash happens, who is involved, and which local or state agencies may hold important records.

A car accident on the I-210, for example, may involve different agencies and roadway records than a crash on Huntington Drive or another city street. Crashes involving pedestrians, bicyclists, or several vehicles may also raise different questions about fault, injuries, and available insurance coverage.

I-210 Crashes May Involve CHP and Caltrans Records

The I-210 Foothill Freeway runs through Duarte, with local access near Buena Vista Street and other nearby streets. A multi-vehicle freeway crash may involve many drivers, competing accounts of how the collision occurred, and evidence from multiple sources.

The California Highway Patrol (CHP) generally handles collisions on the I-210, while Caltrans District 7 manages the state highway infrastructure in this area. Depending on the crash, useful evidence may include the CHP collision report, vehicle data, witness statements, photographs, and relevant Caltrans maintenance or roadway records.

Huntington Drive Crashes May Have Different Evidence Sources

Huntington Drive is one of Duarte’s main corridors, supporting local vehicular and pedestrian traffic, commercial activity, and transit service. A crash near Encanto Parkway, Mount Olive Drive, or another intersection may involve evidence sources different from those in a freeway collision. Depending on the location, evidence can include:

  • Nearby business or residential video
  • Vehicle camera footage
  • Witness accounts
  • Traffic signal information
  • Other roadway records

Because privately held video may be overwritten, potentially relevant footage should be identified and preservation requested promptly.

The Investigating Agency Depends on Where the Crash Happened

The agency that investigates a Duarte crash can depend on whether it occurred on a local street or the freeway. Duarte contracts with the Los Angeles County Sheriff’s Department’s (LASD) Temple Station for local law enforcement services, while the CHP generally handles I-210 freeway collisions.

That distinction matters because the collision report and related records may need to be requested from different agencies. A traffic collision report can document the scene, statements, citations, and an officer’s observations, but it does not, by itself, determine civil liability.

Nearby Medical Care Can Shape Recovery After a Crash

A person seriously injured in Duarte may receive emergency treatment at a nearby hospital, such as Emanate Health Foothill Presbyterian Hospital in Glendora or USC Arcadia Hospital in Arcadia. Both provide 24-hour emergency care.

If a crash causes more serious injuries, the patient may be taken to a designated trauma center, such as Huntington Hospital in Pasadena. Where someone is treated can depend on the severity of the injuries, EMS routing, and the level of care needed.

The type of treatment can affect the course of a car accident claim. Hospitalization, surgery, specialist care, rehabilitation, and follow-up treatment can all increase medical expenses, time away from work, and the amount of damages that may be claimed.

Where Duarte Car Accident Lawsuits Are Filed

An unlimited personal injury lawsuit arising from a Duarte car accident generally belongs in the Northeast District of the Los Angeles Superior Court. Under Local Rule 2.3(a)(1)(A), these lawsuits must be filed in the judicial district where the crash occurred.

The court’s current Filing Court Locator lists Alhambra Courthouse and Pasadena Courthouse for unlimited civil cases from Duarte, ZIP code 91010. Your attorney can confirm the appropriate filing location and court assignment before submitting the lawsuit.

Possible Injuries from a Duarte Car Accident

Car crashes in Duarte can cause injuries ranging from minor strains to serious head, spine, bone, or internal injuries. Crashes on the I-210 may involve higher speeds, while collisions on Mount Olive Drive may involve drivers, pedestrians, or bicyclists. The type and severity of injury depend on how the crash happened, the force of impact, and the people involved.

These are common injuries in car accidents:

Traumatic Brain Injuries (TBIs)

A TBI can range from a concussion to a severe brain injury. Symptoms may include headaches, dizziness, confusion, memory problems, or changes in mood or sleep. Some symptoms may appear right away, while others can take hours or days to develop. A doctor can decide whether further testing or specialist care is needed.

Spinal Cord and Soft Tissue Injuries
A spinal cord injury can cause loss of movement or sensation below the level of injury. Soft-tissue injuries, such as whiplash, can cause neck pain, stiffness, and limited range of motion. Treatment may include medication, physical therapy, or other care based on the injury.
Broken Bones and Orthopedic Injuries
A serious collision can cause fractures to the arms, legs, ribs, pelvis, or face. Some fractures may require surgery, hardware, and weeks or months of rehabilitation.
Internal Injuries
A hard impact can injure organs or cause internal bleeding. These injuries may not always be obvious at the crash scene and may require medical testing to diagnose.
Emotional and Psychological Injuries
A serious crash may also lead to anxiety, depression, or post-traumatic stress disorder. These effects may be part of a personal injury claim when they are caused by the crash and supported by the facts.

Medical records, imaging results, and treatment history can help connect these injuries to the crash and document their severity. Notes about symptoms, work restrictions, and daily limitations can also show how the injuries affect your life. Together, this evidence may support compensation.

What Damages Can You Recover from a Car Accident in Duarte?

The compensation available after a Duarte car accident depends on the injuries, financial losses, and facts of the case. The main types of damages recoverable are economic and non-economic. In some cases, additional damages may also be available when the defendant’s conduct meets a higher legal standard.

Economic damages cover financial losses caused by the crash. For example:

Non-economic damages cover personal losses that do not come with a set dollar amount. For example:

California’s Proposition 213 generally bars non-economic damages for injured owners of uninsured vehicles and drivers who cannot establish legally required financial responsibility. Economic damages, such as medical expenses and lost income, may remain recoverable. An exception allows an uninsured vehicle owner to recover non-economic damages when the other motorist caused the injury while driving under the influence (DUI) and was convicted.

Punitive Damages

Under California Civil Code § 3294, punitive damages may be awarded only when the plaintiff proves by clear and convincing evidence that the defendant acted with oppression, fraud, or malice.

A DUI crash does not automatically qualify for punitive damages. In some cases, however, the facts surrounding impaired driving may support a finding that the driver acted with conscious disregard for the safety of others. Punitive damages are intended to punish and deter wrongful conduct rather than to compensate the injured person for ordinary losses.

Wrongful Death and Survival Actions

When a Duarte car accident is fatal, eligible family members may seek compensation through a wrongful death claim or a separate survival action. Both actions may arise from the same crash but cover different types of losses.

Wrongful death claims compensate eligible family members or other qualifying claimants under CCP §377.60 for their losses. Even though California does not separately award wrongful death damages for grief, sorrow, or mental anguish, the available losses may include:

  • Lost financial support.
  • Loss of love and companionship.
  • Loss of comfort, care, and assistance.
  • Loss of protection, affection, society, and moral support.

Survival actions cover certain claims that belonged to the deceased person before death. The decedent’s personal representative or successor in interest may seek qualifying losses such as:

  • Medical expenses incurred before death.
  • Lost income before death.

Damages in both legal actions may be supported by records such as medical bills and treatment records, pay statements and employment records, testimony about the losses caused by the death, and expert analysis when future financial losses are disputed.

How Insurance Works in Duarte Car Accident Claims

Several types of insurance may apply to a car accident in Duarte. Which coverage is available depends on the drivers, vehicles, and circumstances involved. Identifying all applicable policies and their limits helps determine potential sources of compensation.

  • Auto Liability Coverage: The at-fault driver’s auto insurance is the primary coverage for the accident. California’s standard minimum auto liability limits are:
    • $30,000 for injury or death to one person.
    • $60,000 for injury or death to more than one person in one crash.
    • $15,000 for property damage.

These limits are set out in California Insurance Code § 11580.1(b), as amended by SB 1107, and apply to policies issued or renewed on or after January 1, 2025. A policy limit does not necessarily cap the at-fault person’s legal liability, and other insurance or responsible parties may also be available. For example, some drivers and commercial vehicles carry higher limits.

  • Uninsured/Underinsured Motorist (UM/UIM) Coverage: California insurers must offer UM/UIM coverage as part of an auto liability policy. A policyholder may reject it by signing a written waiver. If coverage is in place, it may help when the at-fault driver has no insurance or insufficient coverage to cover the loss. UM coverage may also apply when the at-fault driver flees the scene of the crash.
  • Commercial and Employer Policies: If a crash involves a delivery vehicle, commercial truck, or employer-owned vehicle, a commercial liability policy may apply. For example, an I-210 crash involving a delivery truck or a work vehicle on Huntington Drive. Coverage depends on factors such as vehicle ownership, policy language, exclusions, and whether the driver is acting within the scope of employment.

An insurer may request statements, medical information, repair estimates, and other records when reviewing a claim. It may also make a settlement offer before the full extent of the injuries or future costs is known.

Because accepting a settlement usually requires signing a release, it is important to understand all potentially available coverage and the losses being claimed before resolving the case.

Proving Fault in a Duarte Car Accident

Proving fault in a Duarte car accident generally means showing that another party’s failure to use reasonable care caused your injuries and losses. For example, fault may be based on conduct such as running a red light on Mountain Avenue.

To file a car accident claim, you usually require proof of four elements of negligence:

  • Duty: Drivers must use reasonable care to avoid harming other road users.
  • Breach: A driver breaches that duty by failing to use reasonable care, such as by speeding, running a red light, or driving distracted.
  • Causation: The driver’s conduct must have caused or contributed to the crash and your injuries.
  • Damages: You must have suffered losses, such as medical expenses, lost income, property damage, or pain and suffering.

Who May Be Liable for a Car Accident?

Liability for a Duarte car accident may extend to several parties. Identifying responsible parties requires examining how the crash happened, who owned or controlled the vehicle or road, and whether the driver was working.

  • The Driver: A driver may be liable when negligent driving causes or contributes to the crash.
  • The Vehicle Owner: Under California Vehicle Code §17150, a vehicle owner may be liable when another person drives the vehicle with the owner’s express or implied permission and causes injury through negligent operation. Statutory limits may apply to this type of owner liability.
  • An Employer: An employer may be responsible when an employee causes a crash while acting within the scope of employment. For example, this issue may arise if a delivery driver or commercial vehicle operator causes a collision on Central Avenue while performing job duties.
  • The City of Duarte: The City may be responsible in some cases involving a dangerous condition on property it owns or controls. Under Government Code 835, liability generally requires proof that the condition created a foreseeable risk and caused the injury. It was either created by a public employee or known to the public entity long enough for the public entity to take protective action.
  • Los Angeles County: The County may be involved when a crash is connected to a road or other property under County control, including certain areas outside Duarte’s city limits.
  • Caltrans: If a dangerous roadway condition contributed to a crash on the I-210, Caltrans may be a potential defendant depending on the facts.

More than one party may share responsibility, even the injured victim. In that case, California uses a pure comparative fault system. Under this, being partly responsible for a crash does not automatically prevent you from recovering damages. Instead, your compensation is reduced by your share of fault. For example, if your damages total $100,000 and you are 20% at fault, you may recover $80,000 from the other responsible party.

What to Expect After Filing a Duarte Car Accident Claim

A Duarte car accident claim usually moves through several stages, from the initial investigation to settlement negotiations or litigation. The exact process depends on the injuries, available insurance, disputed issues, and the parties involved.

1. Investigation and evidence review.
The claim often begins with reviewing the collision report, photos, witness statements, vehicle information, and any available video or roadway records. For Duarte street crashes, records may come from LASD Temple Station, while I-210 collisions may involve the CHP or Caltrans.
2. Medical treatment and documentation.
As treatment continues, medical records help show the nature of the injuries, the care provided, and any ongoing limitations. These records may include emergency care, imaging, specialist visits, therapy, prescriptions, and work restrictions.
3. Evaluation of damages.
Once the injuries and financial losses are sufficiently clear to assess, the claim is evaluated for medical expenses, lost income, reduced earning capacity, property damage, and non-economic losses, such as pain and suffering.
4. Insurance demand and negotiation.
A demand may then be presented to the applicable insurer or insurers. This stage usually involves reviewing liability, medical treatment, financial losses, policy limits, and the amount requested to resolve the claim.
5. Settlement or lawsuit.
Some claims resolve through negotiation. If the parties cannot reach an agreement, a lawsuit may be filed in the Los Angeles Superior Court.

The length of the process varies. A straightforward two-vehicle claim may move faster than a case involving serious injuries, several vehicles, a commercial defendant, disputed fault, or a public entity.

Filing Deadlines for Duarte Car Accident Claims

The deadlines for a Duarte car accident case depend on the type of loss and whether a private party or public entity is involved. Lawsuits, government claims, and insurance claims can have separate deadlines. Missing an applicable deadline may prevent you from pursuing compensation, so identifying the filing requirements early is essential.

  • Personal Injury: Under CCP § 335.1, a personal injury lawsuit against a private party generally must be filed within two years after the injury. In a typical car accident case, that period begins on the date of the crash.
    • If the victim is a minor, the 2-year deadline tolls until they turn 18. This exception doesn’t apply to claims against government entities.
  • Property Damage: Under CCP § 338(c)(1), a lawsuit for damage to a vehicle or other personal property must be filed within three years after the claim accrues.
  • Government Claims: If a crash may involve the City of Duarte, Los Angeles County, or Caltrans, California’s Government Claims Act requires a written claim for personal injury, death, or property damage to be presented within six months after the claim accrues. In a typical crash, accrual often occurs on the date of the collision. The entity has 45 days to react.
    • If the public entity sends a written rejection notice that complies with Government Code §913, you generally have six months to file a lawsuit. That period begins when the notice is personally delivered or deposited in the mail.
    • If no compliant written notice is given, the lawsuit deadline is generally two years after the claim accrues.

If you miss the initial six-month claim deadline, you may apply for permission to present a late claim. Under Government Code §911.4, that application generally must be submitted within a reasonable time, no later than one year after accrual. Approval is not automatic.

Frequently Asked Questions About Car Accidents in Duarte

A police report is generally not required to file an insurance claim, but it can help support your case. Duarte contracts with the LASD Temple Station for local law enforcement, while the CHP typically investigates crashes on I-210. If a report exists, request a copy through LASD’s records process or CHP’s crash report system, depending on which agency investigated.

In addition to that, California Vehicle Code § 20008(a) requires drivers involved in a crash that causes injury or death to submit a written report to the CHP or the appropriate city police department within 24 hours.

Separately from any police report, California requires drivers to file an SR-1 report with the Department of Motor Vehicles (DMV) within 10 days of a crash if anyone was injured or killed, or if property damage exceeded $1,000. This applies regardless of who was at fault, and failing to file can lead to suspension of your driver’s license.

Your auto policy may include Uninsured/Underinsured Motorist (UM/UIM) coverage. This coverage may help if the at-fault driver has no insurance or insufficient coverage to cover your losses. California insurers must offer UM/UIM coverage, but policyholders can reject it in writing. Whether it applies and how much coverage is available depends on your policy and the facts of the crash.

If a public entity may be responsible for your crash, special claim rules apply. For personal injury, death, or property damage claims, California generally requires that a written government claim be presented within six months after the claim accrues.

For example, Caltrans may be involved if a dangerous condition on the I-210 contributed to the crash. In contrast, the city or county may be involved if a condition on property under its control contributed to the crash.

Many car accident attorneys handle cases on a contingency fee basis. Under this type of agreement, the attorney’s fee is usually paid from the recovery rather than up front. The written fee agreement should explain the percentage charged, how case costs are handled, and whether any costs may still be owed if there is no recovery.

There is no set timeline for a Duarte car accident case. The length of the case can depend on the severity of the injuries, how long treatment lasts, whether fault is disputed, how many parties are involved, and whether the claim settles or proceeds as a lawsuit.

If a lawsuit is filed, the case may also involve discovery, court conferences, settlement discussions, motions, and possibly a trial. Each case moves at its own pace based on the facts and issues involved.
