How Do You Obtain a Police Report Following an Accident

Drivers in California are obligated to report incidents to the Department of Motor Vehicles (DMV) within ten (10) days if injuries, fatalities, or property damage exceed $1,000.

Section 20008 of the California Vehicle Code requires drivers to report crashes that result in fatalities or injuries within 24 hours to the California Highway Patrol.

People can report to the DMV and the California Highway Patrol in two ways:

  1. A police officer is usually called to the scene of an incident. You will receive a police report, the police will conduct an investigation, and they will submit the report on your behalf to the DMV and CHP.
  2. You can file the report with the DMV and CHP yourself. The forms should be completed immediately and forwarded to the appropriate department if this is the case.
