What To Do If A Loved One Was Fatally Injured In A Pedestrian Accident

Losing a loved one in a pedestrian accident is a heartbreaking and life-changing experience. During this time, families are often left with many questions, emotional pain, and unexpected responsibilities. While no steps can undo the loss, there are actions you can take to help protect your family’s rights and access support.

  1. Make Sure The Incident Is Properly Reported
Law enforcement usually investigates fatal pedestrian accidents. If you are a family member, try to obtain the police report when it becomes available. It often contains key details about the crash.
  2. Request A Copy Of The Medical Examiner’s Report
The coroner or medical examiner will typically issue a report following the incident. This may include the cause of death and other important findings.
  3. Gather Any Available Information
If you are able, collect contact details for any witnesses or others who were at the scene. Photographs, news articles, and personal items related to the crash may also be helpful to keep.
  4. Keep Records Of All Related Expenses
This can include funeral costs, emergency medical care, travel, and other unexpected expenses. Keeping organized records can help you better understand the financial impact over time.
  5. Avoid Early Insurance Discussions Without Legal Support
You may be contacted by an insurance company shortly after the accident. It’s okay to take your time. You are not required to make any immediate decisions or sign anything right away.
  6. Speak With A Lawyer
An experienced lawyer can help your family understand what legal options may be available, including filing a wrongful death claim if appropriate. They can also guide you through the process and handle communication on your behalf.

Pedestrian Accident Statistics

Walking is a healthy and common way to get around, but it can also be dangerous, especially near busy roads. Unlike drivers or passengers in cars, pedestrians do not have any physical protection, which makes them more likely to get hurt in an accident.

In 2022, there were 1,158 pedestrian deaths reported in California. This was a slight drop of about 1.8% compared to 2021. Even though the number went down a little, pedestrian safety is still a major concern because people who walk near traffic are always at risk.
