Truck Crash Statistics
A crash between a commercial truck and a personal car can be much worse than a crash between two personal cars. A typical commercial truck (like a big rig or dump truck) that is fully loaded can weigh at least 25 times as much as a typical car. Because of this huge difference in weight and the laws of physics, most accidents between big rig trucks and other cars cause serious or even fatal injuries.
According to the U.S. Department of Transportation, 4,995 people died, and 106,000 were hurt in large truck accidents in 2006. Most of the time, these accidents are not the truck driver’s fault. They may be caused by things on the road that the truck driver didn’t see coming or other drivers who didn’t pay attention.
Another thing that can worsen truck accidents is the truck’s cargo. For instance, if a big rig with dangerous or flammable cargo (like gasoline or industrial waste) gets into an accident, the dangerous cargo can cause more injuries.
Riverside County Truck Accident Lawyers
In commercial truck accident cases, “negligence” is the primary legal theory of liability, as it is in most personal injury cases involving vehicles. It’s important to find as many possible liable parties as possible to get money for injuries caused by a truck accident. In most cases, trucking companies, contractors, employers, and insurance companies may have to pay for your injuries.
If a truck driver works for a trucking or shipping company, that company could be held legally responsible for the driver’s mistakes. Your lawyer would have to prove that the company had control over the driver and that the accident happened while the driver was doing work-related things.
This can be a problem when a truck driver works as a freelancer for a bigger company. In this case, the most important thing is how much supervision the company does. The potential liability of trucking companies, employers, and contractors is a key part of figuring out how much insurance coverage is needed for recovery since each of these groups probably has its own policy.
