Who We Help After A Supercar Accident

Arash Law helps victims of supercar crashes across California. This includes drivers, passengers, pedestrians, cyclists, and bystanders. Contact our California supercar accident lawyers, and we will evaluate your case and discuss how we may be able to help. Under California’s negligence law, a driver who fails to use reasonable care can be held liable. If that applies to your case, you may seek compensation for medical bills, lost wages, and property damage.

Supercar crashes are not like normal accidents. These cars move at extreme speeds and can be involved in high-speed impacts. Specialty insurance on these cars makes each claim harder to resolve. These vehicles store digital data that can help determine how the crash occurred.

These cases call for attorneys who know how exotic cars behave in a crash and what evidence to look for. They also require a legal team that can challenge insurers who fight hard to protect high-value vehicles. Our attorneys bring both of those capabilities to every supercar claim.

Why Supercar Accident Victims Call Arash Law

Supercar claims are complex. The cars cost more, and specialty insurers fight hard to limit their payouts. Victims call Arash Law because these cases need a team that knows them.

Here is how we can help:

  • Preserve any available data from the vehicle’s Event Data Recorder (EDR) before it may be overwritten. EDR and telematics systems log speed and driving behavior, and can be key to your claim.
  • Build diminished value claims to seek money for the drop in your car’s resale value.
  • Coordinate factory-certified repair estimates to help protect against insurers’ undervaluing the damage cost.
  • Work with crash reconstructionists to prove speed, fault, and cause.
  • Challenge specialty insurers that try to cut or deny compensation you may be entitled to.
  • Send preservation notices that identify vehicle data, video, photographs, records, and other evidence that may relate to the crash.

If your supercar was in a crash, reach out for a free consultation. Not sure if you qualify? The next step is understanding who can file one of these claims.

Who Can File A Supercar Accident Claim?

If a supercar driver caused your injury, you may have a claim in California. That includes people riding inside the at-fault car, not just those the supercar struck.

You may have a claim if you are:

  • A driver or passenger in a car that was hit by a supercar.
  • A passenger inside the supercar, even if the driver is a friend or family member.
  • A pedestrian, cyclist, or scooter rider struck by a speeding exotic car.
  • An owner whose exotic or high-value vehicle was damaged by another party’s negligence.
  • A surviving spouse, domestic partner, child, or another person who has the right to file under California Code of Civil Procedure § 377.60 after a fatal supercar crash.

California has specific rules on who can file, when to file, and who is liable. Those rules affect how your claim can proceed.

Why Supercar Accident Cases In California Are Different

Supercar crash claims in California are unlike typical car cases. Three local factors set them apart: CHP enforcement, access to public records, and the cost of repairing exotic cars. These factors shape how fault is proven and how your losses are measured.

Key California signals that affect these cases include:

  • High-Speed Enforcement: Excessive speeding remains a major safety issue across California. The UC Berkeley Safe Transportation Research & Education Center (SafeTREC) reported that speeding-related crashes killed 1,303 people in California in 2023. In addition, California Highway Patrol (CHP) officers issued more than 30,500 citations for speeds above 100 mph during special enforcement efforts from January 2023 through July 2024. A citation or collision report doesn’t prove civil liability on its own. However, it may include statements, diagrams, measurements, and observations. These elements can help explain how a crash happened.
  • Street Racing Laws: California Vehicle Code § 23109 prohibits speed contests and exhibitions of speed on highways and in off-street parking facilities. Evidence of racing, burnouts, or dangerous acceleration may help support a negligence claim. Punitive damages require additional proof that the conduct met California’s legal standard.
  • Canyon and Coastal Roads: Winding routes such as Mulholland Highway, Pacific Coast Highway, Angeles Crest Highway, and Mulholland Drive are popular with driving enthusiasts. A safety review of an 8-mile stretch of Mulholland Highway in Los Angeles County (known as ‘the Snake’) found 49 serious injuries and four deaths from 2013 to 2023. Many crashes involved vehicles leaving the roadway or striking fixed objects.
  • California Crash and Roadway Records: CHP collects injury and fatal crash information through California’s statewide crash-reporting system. An attorney might look for various documents based on the location. These can include collision reports, dispatch records, and roadway plans. They may also seek traffic studies, signal-timing records, maintenance records, or construction documents from CHP, Caltrans, a city, or a county. These records may help identify factors that contributed to the crash.
  • Limited Access to Caltrans Camera Images: Caltrans operates traffic cameras throughout its 12 districts, including those covering Los Angeles, San Diego, Orange County, the Bay Area, Sacramento, Fresno, and the Inland Empire.

Caltrans traffic cameras may provide live or periodically refreshed images, but recording and retention practices can vary by camera system, district, or project. A claimant should promptly ask the responsible Caltrans district whether any footage, photographs, or other recorded data exist. A supercar accident attorney may need to look for video from nearby businesses, homes, dashcams, local agencies, or privately operated traffic systems instead.

  • Regional Repair-Cost Disputes: Auto-body labor rates can vary by geographic area. The California Department of Insurance hosts public information about labor-rate surveys submitted by insurers. Insurers may conduct qualifying surveys and use the results to set a prevailing auto-body labor rate for a defined geographic area. This issue is important when an insurer compares a factory-certified estimate from high-cost areas like Los Angeles, Orange County, or the Bay Area with a lower estimate from a different region.

California supercar accident lawyers know how to use CHP reports, Caltrans data, and repair records to show who is at fault. Each of these factors ties directly to legal responsibility for the crash. The accident lawyers at Arash Law know which records to pull and how to connect California-specific evidence to the parties who caused the harm.

Who May Be Liable For A Supercar Crash In California?

More than one party can be held legally responsible for a supercar crash. Many supercar-crash claims are based on negligence. Depending on the facts, other legal theories may apply, including strict product liability for a defective vehicle or component and statutory public-entity liability for a dangerous condition of public property.

That means a person or company failed to use reasonable care and caused harm. Every driver owes a legal duty of care to operate their vehicle safely. A driver may breach the duty of care by racing, speeding, or otherwise handling a high-powered car without reasonable care. The driver is not always the only party who can be sued.

These parties may be liable for a supercar crash:

  • At-Fault Driver: The driver who caused the crash is the primary defendant, meaning the party being sued. Speeding, street racing, and reckless driving may support a negligence claim.
  • Vehicle Owner: Under CACI 724, an owner may be liable for negligent entrustment if the owner knew or should have known that the driver was unfit to operate the vehicle and that unfitness helped cause the crash.
  • Employer: If the driver was acting within the course and scope of employment at the time of the crash, the employer may be vicariously liable under the doctrine of respondeat superior.
  • Rental Agency: A rental company may be liable for its own negligence, such as negligent maintenance or knowingly renting to an unfit driver.
  • Mechanic or Repair Shop: A shop that did faulty work or added unsafe modifications can be held liable if those issues caused the crash.

California follows pure comparative fault under CACI 405. This means you can still recover money even if you were partly at fault. Your share of fault reduces any compensation you may recover, but it does not bar your claim. A careful investigation can identify each person or company whose conduct may have contributed to the crash. Traffic accident lawyers can map those targets from the start.

What Compensation May Be Available After A Supercar Accident?

You may be able to recover money for medical bills, lost income, property losses, and personal harm. Recoverable damages may include compensatory damages—economic and non-economic—and, in qualifying cases, punitive damages. Supercar cases may involve unusually high repair costs, total-loss valuations, or diminished-value disputes compared with ordinary vehicle claims.

California law allows these types of damage in personal injury claims:

  • Economic Damages:
    • Medical Costs: Emergency medical bills and rehab costs.
    • Lost Income: Lost wages while you heal. If your injuries affect future work, you may also claim reduced earning ability.
    • Diminished Value: Even after full repairs, your car may lose market value. That loss may be a valid property claim in many supercar cases.
    • Loss of Use: The cost of a replacement or rental vehicle while your exotic car is being repaired.
  • Non-Economic Damages:
    • Pain and suffering tied to your injuries and recovery.
    • Emotional distress, such as anxiety or trauma from the crash.

Punitive damages may be available when clear and convincing evidence shows malice, oppression, or fraud under Civil Code § 3294. Extreme racing or intoxicated driving may support such a claim when the facts show a willful and conscious disregard for safety.

Getting paid depends on the coverage that is in place. Some victims seek free advice from a supercar accident lawyer to help determine what coverage may apply in their situation.

How Insurance Applies To Supercar Claims

What you can recover in a supercar crash depends on which policies apply and what they cover. These cases often involve multiple insurance layers. Each layer has its own rules and limits.

Key coverage issues to know:

  • Specialty Policy Exclusions: Many high-end car owners carry specialty or collector policies. These often exclude track days, racing, and unlisted drivers. If the at-fault vehicle has no applicable liability coverage, the injured person may need to examine any available UM or UIM coverage. Whether it applies depends on the policy and the facts.
  • UM/UIM Coverage: UM/UIM coverage may apply if the claimant qualifies as an insured and the coverage was not rejected or limited. For an unidentified hit-and-run driver, California generally requires physical contact, a police report within 24 hours, and a sworn statement to the insurer within 30 days. UIM coverage generally applies only after applicable bodily-injury liability limits have been exhausted.
  • Rental Car Coverage: If the exotic car was a rental, more than one policy may apply. Potential coverage may include the renter’s personal or commercial auto policy, supplemental liability protection, applicable rental-company coverage, umbrella insurance, and other contract-based coverage.
  • Proposition 213 Limits: Under Proposition 213, an uninsured owner or operator of a vehicle generally cannot recover noneconomic damages arising from the crash. The rule does not apply to every injured person who lacks a personal auto policy, and statutory exceptions may apply.

Insurers use exclusion language to contest claims and limit what they pay. Pursuing the most the law allows requires solid proof gathered right after the crash.

What Evidence Matters In A Supercar Claim?

Digital vehicle data can be especially important in a supercar case. These can be overwritten or lost within days of the crash. EDRs may record pre-impact speed, throttle input, and braking application. Depending on the crash event, they may also capture delta-v, which is the change in velocity at the moment of impact. Some supercars also include telematics systems that may capture similar data. Once this information is overwritten, other evidence may still establish fault, but the specific measurements contained in that data may be impossible to recreate with precision.

Evidence that should be preserved quickly includes:

  • EDR and telematics data showing pre-impact speed, braking, and throttle input.
  • Dashcam footage from the striking vehicle or nearby vehicles.
  • Traffic, business, and intersection videos should be requested promptly because retention policies vary, and some systems do not archive footage at all.
  • Skid marks, road gouges, and debris fields (documented by photos before the scene is cleared).
  • Police and CHP collision reports, including diagrams and measurements.
  • Phone and app records may be relevant, but their availability and retention periods vary by provider and by the type of data requested.
  • Vehicle modification records, including engine tune invoices, performance modification records, and non-factory parts receipts.
  • Maintenance records and prior repair history that may reveal unsafe mechanical conditions.

This evidence may help experts evaluate crash severity, driver inputs, and the forces involved in the collision. A supercar injury attorney can collaborate with these experts to interpret the findings and strengthen the evidence supporting your claim.

Supercar Injuries And How They Affect Compensation

When a supercar crashes at very high speed, the impact may expose occupants and others to greater forces and a higher risk of severe or multiple injuries. Supercars are usually lower to the ground, meaning occupants may experience impact from different angles than occupants of other cars. More severe injuries mean higher medical bills, longer recovery, and a claim that may need to account for years of ongoing care.

Common injuries in high-speed supercar crashes include:

  • Traumatic Brain Injury (TBI) and Concussions: A hard jolt at high speed can harm the brain. You may have memory loss, mood changes, or trouble focusing. These effects can last for years and limit your ability to work.
  • Spinal Cord Injuries: Damage to the spinal cord can cause partial or complete paralysis. Spinal-cord injuries can cause lasting impairment or paralysis, although recovery differs depending on the type and severity of the injury. Care costs, equipment, and home changes add up over a lifetime.
  • Severe Fractures and Broken Bones: High-speed impact can break bones in your arms, legs, and ribs. Surgery and hardware are common. Recovery can take months.
  • Burn Injuries: Supercar fires cause deep burns that need skin grafts and long-term wound care. Repeated procedures are often required.

Some survivors need physical therapy, specialist care, or other long-term rehabilitation. Any chiropractic treatment should be based on the patient’s condition and a qualified provider’s advice.

Fully capturing the impact of these injuries takes more than a stack of medical bills. You need to follow the right legal and medical steps from the start to build a record that properly supports your claim.

How Long Do You Have To File A Supercar Claim?

State law gives you two years from the date of your injury to file a personal injury lawsuit under California Code of Civil Procedure (CCP) § 335.1. Missing this deadline permanently ends your right to seek compensation, regardless of how clear the other driver’s fault was.

Your filing window depends on the type of claim and who was involved:

  • Personal Injury Claims: Two years from the date of injury under CCP § 335.1.
  • Property Damage Only: Three years from the date of the crash under CCP § 338.
  • Government Entity Claims: If Caltrans, a city vehicle, or another public agency is involved, you must file an administrative claim (a formal written request submitted directly to the agency) within six months under Government Code (Gov. Code) §911.2. This must happen before any lawsuit can proceed.

Some deadlines are paused by law. For the personal injury and property damage deadlines above, if the injured person is under 18, the clock does not start until they turn 18 under CCP § 352. This tolling provision does not extend the six-month government claim deadline, which runs on its own rules under the Government Claims Act.

If a crash leaves someone legally incapacitated, the clock may pause until they regain capacity. This exception applies only where a court or medical evidence establishes the person lacks the legal capacity to make decisions about their affairs — it does not apply simply because someone is struggling to cope, in shock, or temporarily overwhelmed after a crash. An attorney can help determine whether this exception applies to a specific case.

Every deadline above runs from a fixed date, and the clock does not pause for insurance negotiations. The sooner an attorney is involved, the better the chance of protecting your claim before those windows close.

What Typically Happens After A Supercar Claim Begins

A supercar claim often involves several stages, but their order and timing depend on the injuries, evidence, insurance, and disputed issues. Some cases close in a few months. Others take two or more years.

  1. Evidence Collection: An exotic car injury lawyer secures the police report, requests preservation of the car’s EDR, and gathers photos and medical records.
  2. Medical Stability and Demand Package: In some cases, counsel waits until the claimant’s condition, prognosis, and future treatment needs are sufficiently understood before sending a demand. A formal finding of Maximum Medical Improvement is not required in every personal-injury claim, and timing depends on the medical evidence and applicable deadlines. An attorney then submits a formal demand covering your medical costs and long-term needs.
  3. Lawsuit and Discovery: If the insurer refuses a fair settlement offer, a supercar injury lawyer can file a lawsuit. Both sides then share evidence through depositions (sworn statements taken outside court), document requests, and written questions.
  4. Alternative Dispute Resolution (ADR) or Trial: Many cases resolve through mediation, in which a neutral third party helps both sides reach a settlement. If that fails, the case goes to trial, and each step has legal deadlines that must be met.

Why Hire Arash Law For A Supercar Claim?

When you realize “I need a personal injury lawyer,” it is often because an insurer has already acted. They may have sent a low offer, delayed their response, or requested a recorded statement to limit your claim. Supercar insurers are well-funded and move fast. Arash Law moves faster.

  • We handle all communications with the insurer from day one. That means no recorded statements, no direct contact, and no room for adjusters to shape the narrative against you.
  • If a case needs to go to trial, we take it to trial. Insurers know this. That posture is what turns a dismissible demand into one they have to take seriously.
  • We work with medical experts, forensic economists, and accident reconstruction professionals. Their analysis builds the foundation that complex, high-value cases require.
  • There are no upfront costs. We work on a contingency basis, so you pay no attorney’s fees unless we win.

Frequently Asked Questions About Supercar Accidents

A supercar accident raises questions that standard crash cases do not. You may wonder whether your status as a passenger changes your rights, what happens to the high-value vehicle you lost, or whether an early settlement offer is too good to pass up. If you are still unsure about costs, fault, or whether your situation even qualifies, the answers below address those doubts directly.

In most cases, yes. Passengers rarely share fault for a crash. You can file a claim against the at-fault driver’s insurance, whether that is the driver of the supercar or another vehicle involved. California law generally allows passengers to seek compensation for medical bills, lost wages, and pain and suffering.

One exception: under Proposition 213, a passenger who owns a vehicle and carries no insurance on it may be barred from recovering non-economic damages like pain and suffering, regardless of the crash they were in. An attorney can confirm whether this applies to your situation.

That said, if the supercar’s specialty policy excluded the driver or the circumstances of the ride, recovery may depend on other coverage, such as the vehicle owner’s UM/UIM policy or a separate liability policy — the kinds of issues discussed in the insurance section above.

Yes. Most personal injury attorneys work on a contingency fee basis, meaning you pay no attorney’s fees unless your lawyer wins or settles your case. You do not need money up front to get legal help. The fee is deducted from your recovery only if the case succeeds.

It’s generally advisable to avoid accepting early settlement offers. An early offer may not fully account for future medical care, reduced earning ability, or other long-term losses. A valid release usually ends the claims covered by it, making it difficult or impossible to seek more money for those claims later. Exotic car accident attorneys can evaluate the full value of your claim before you make any decision.

Yes. You do not need a physical injury to file a claim. If another driver damaged your exotic car, you may be able to recover the losses described in the compensation section above, including diminished value and loss of use. Valuing an exotic car may require market data, repair records, appraisals, and evidence of any post-repair loss in value.

California follows a pure comparative negligence rule. This means your percentage of fault reduces your compensation, but you are not blocked from recovering anything. A partial fault does not end your right to seek compensation.
