The Extent Of Liability In These Types Of Cases

Festival organizers have a legal responsibility to take precautions to maintain the safety of their property. According to the California Civil Code § 1714 Section (a):

“Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself“.

This includes taking precautions to prevent guests from being struck by hanging objects. There are several sources of potential negligence if a guest is hit by a falling object, such as:

  • Subcontractor errors.
  • Faulty tools or machinery.
  • Bad weather or protection against it.
  • OSHA-related work violations.
  • Improperly fastened bolts, screws, or hinges.

Victims who are struck by falling objects can suffer traumatic brain injuries. According to the Mayo Clinic, “Traumatic brain injury can have wide-ranging physical and psychological outcomes. Some signs or symptoms may appear quickly after the traumatic event, while others may appear days or weeks later.” Even victims who produce a complete physical healing can be left with ongoing psychological ailments, including post-traumatic stress disorder.

Typical Symptoms Of PTSD Include:

  • Unwanted flashbacks of the traumatic experience.
  • Avoidance of people, places, sights, and sounds that are reminders of the event.
  • Hyper-vigilance and constant alertness to risks.
  • Feelings of detachment from people and emotional numbness.

According to one study from Northwestern University, the lifetime costs associated with treating a severe brain injury can be significant. Any person who is injured due to the negligence of festival organizers might have the ability to pursue an injury claim for damages, depending on the specifics of the case.

Damages can include compensation for lost wages, medical bills, and pain & suffering.
