Negligent Security Facts
When it comes to physical assault cases, things can get very unexpected. A mass shooting, for example, can leave victims with no idea who to hold responsible for their deaths, let alone the perpetrators of such heinous crimes.
A business or property can’t predict the future. Nonetheless, they must establish reasonable security precautions to protect authorized guests against crimes that can be predicted in advance.
If the crime might have been prevented or less likely to occur if effective security had been in place, the property owner may be charged with negligent security. Both residential and commercial property owners can be held liable for safety violations. However, the property determines the extent of the owner’s responsibilities.
Property owners in California are liable for criminal conduct committed by third parties if they fail to take reasonable precautions to protect their property. Enhanced security may be required if there is a history of violent crime, such as robberies, assaults, or bar fights, in the vicinity.
