[08-14-2023] Elementary Students Became Ill After Food Poisoning Incident in Palo AltoA group of elementary students got sick after eating spoiled lunch in Palo Alto on Monday afternoon, August 14, 2023.

The Santa Clara County Department of Environmental Health responded and visited Palo Alto Elementary School and other school sites at an unspecified time.

Thirteen Palo Alto elementary students were given spaghetti as their lunch. There was mold on the bell peppers, and the food was burned. After this, several students started getting sick.

There were reports of students getting sick from lunch in at least four schools. Foodborne illnesses were also reported at Fairmeadow and Hoover. Some of them were vomiting and had a fever. It was unknown if they were taken to a hospital for treatment.

There was no information about the identities or number of people involved. According to the parents, their children got food poisoning after eating moldy meals.

The Palo Alto Unified School District said that the temperature in the refrigerator had changed, causing the spaghetti to spoil. A new oven might be to blame for burned noodles.

The investigation is in progress.

The owner must remove or post warnings for any hazards on the premises. A property owner has failed in their duty of care to anyone who enters their property if they fail to discover a hazard that they reasonably should have fixed or taken precautions to avoid possible injuries.

Supposing the plaintiff establishes these elements and causality (that the defendant’s breach of the duty of care directly caused the plaintiff’s injuries), the defendant would be liable for the plaintiff’s damages.
