What To Do After A DUI Accident In Fresno County, CA

A DUI accident can leave victims in shock, pain, and confusion. What you do in the moments following the crash can significantly impact your physical well-being and legal case. Below are the critical steps personal injury attorneys recommend you follow to protect yourself and your rights:

  1. Move To A Safe Location, If You Can
Your safety comes first. If you are not seriously injured and it is safe to do so, move yourself and others to the side of the road or a secure area away from traffic to avoid further danger.
  2. Call 911 Immediately
Once you’re in a safe location, contact emergency services. Request medical assistance and report the accident to the authorities. A police report will be a crucial piece of evidence, especially in DUI-related cases.
  3. Do Not Engage With The Impaired Driver
Avoid approaching or speaking with the driver suspected of being intoxicated. Their behavior may be unpredictable or confrontational. Wait for law enforcement to intervene and handle the situation.
  4. Document The Accident Scene
Take clear photos and videos of the vehicles, road conditions, skid marks, license plates, visible injuries, and any signs of alcohol or drug use. This evidence can be vital in building your case.
  5. Gather Witness Information
If anyone witnessed the crash, ask them to stay until police arrive. Collect their names and contact information. Witness statements can help strengthen your claim and support your version of events.
  6. Seek Immediate Medical Attention
Get a full medical evaluation, even if your injuries seem minor. Some serious conditions, like internal injuries or head trauma, may not present symptoms right away. Medical records will also support your injury claim.
  7. Avoid Speaking With Insurance Adjusters Without a Lawyer
Insurance companies may contact you quickly in an effort to settle. Do not give statements or accept any offers before consulting with your attorney, as early settlements may not reflect the true value of your case.
  8. Contact An Experienced DUI Accident Attorney
An attorney who specializes in DUI-related personal injury cases can help you navigate the legal process, protect your rights, and fight for the full compensation you deserve. The sooner you seek legal help, the better your chances of a successful outcome.

Drunk driving continues to be one of the leading causes of deadly traffic accidents across the United States. Based on data from the National Highway Traffic Safety Administration (NHTSA), alcohol-impaired drivers were responsible for 11,654 deaths in 2020, accounting for 30 percent of all traffic fatalities nationwide. This marked a 14.3 percent rise compared to 2019, when 10,196 such deaths were reported.

In 2020, one person lost their life to drunk driving every 45 minutes on average. Drivers between the ages of 21 to 24 and 25 to 34 were the most frequently involved in fatal DUI crashes, with each age group representing 26 percent of the impaired drivers in these incidents.

When examining types of vehicles involved, motorcyclists had the highest rate of alcohol involvement in deadly crashes, with 27 percent. Passenger car drivers followed at 23 percent, light truck drivers at 19 percent, and large truck drivers at just 3 percent.

Tragically, young victims were also affected. Of the 1,093 traffic deaths involving children 14 years old and younger in 2020, 21 percent were linked to alcohol-impaired drivers.
