    • Pain and Suffering: Physical pain from injuries and medical treatment, ongoing beyond the day of the crash.
    • Emotional Distress: Post-traumatic stress disorder (PTSD), anxiety, and other mental health issues caused by the crash and its aftermath.
    • Loss of Enjoyment of Life: Hobbies, activities, and relationships the rider can no longer participate in because of the injury.
    • Permanent Scarring and Disfigurement: Road rash, surgical scars, and amputations can change how a rider looks and how they feel about themselves.
  • Wrongful Death Damages: Eligible family members can claim wrongful death damages under CCP § 377.60 and CCP § 377.61. These sections outline how to measure those damages. They include lost financial support and funeral and burial costs. Also, there’s the loss of the companionship, comfort, and care the deceased would have provided.
  • Loss of Consortium: It applies to a spouse or registered domestic partner. It covers the loss of companionship, affection, and support due to an injury.
  • Punitive Damages: Under Civil Code § 3294, courts can award punitive damages if the at-fault party acted with malice, oppression, or fraud. This rule also applies if they showed a conscious disregard for others’ safety. However, the claimant must prove the allegation with clear and convincing evidence. A driver who is very drunk, racing through a Lakewood intersection, or has past DUI convictions may fit this standard.

    Punitive damages are generally not wrongful-death damages. They are not designed to pay the rider; they are meant to punish and deter the conduct. Public entities are immune to punitive damages.
