How Fault Is Proven After a Palmdale Bicycle Crash
Under California negligence law (California Civil Code § 1714), a person may be held responsible if their lack of reasonable care causes another person’s injury. Drivers also have this obligation to act with reasonable care toward others on the road. In a bicycle accident claim, establishing negligence generally requires proof of four elements:
- Duty: The driver had a legal duty to use reasonable care. Under California Vehicle Code § 21200, bicyclists generally have the same rights and duties as drivers when the rules apply to bicycles.
Breach: The driver failed to meet that duty. CVC § 21760, known as the Three Feet for Safety Act, generally requires drivers to leave at least three feet when passing a cyclist. When the cyclist and vehicle are in the same lane, the driver must move into another available lane if practicable, safe, and lawful.
If three feet of space is not possible, the driver must slow down and pass only when it is safe. Other examples include failing to yield, running a red light, or opening a car door into a cyclist’s path.
- Causation: The other party’s actions or inaction must have caused or significantly contributed to the crash and the injuries. Crash reports, dashcam video, surveillance footage, and witness statements may help show what happened.
- Damages: The injured person must show losses caused by the crash. These may include medical bills, lost income, damaged property, pain, and long-term limitations.
California follows pure comparative fault. If more than one person contributed to a collision, damages may be divided according to each party’s share of responsibility.
Who May Be Liable for a Bicycle Accident in Palmdale?
The at-fault driver is usually the main defendant. Depending on the circumstances of the crash, responsibility may extend beyond the driver.
- Motorists: A driver who passes a cyclist with less than three feet of clearance on Rancho Vista Boulevard, turns left across a rider’s path on Sierra Highway, or doors a cyclist stopped near a Palmdale business may bear direct fault. - The property was in a dangerous condition.
- This condition caused the injury and posed a foreseeable risk.
- A public employee negligently or wrongfully created the dangerous condition, or the public entity had actual or constructive notice of it with enough time to take protective measures.
Deadlines for Palmdale Bicycle Accident Claims
Different deadlines may apply after a bicycle accident in Palmdale, depending on the type of claim. Accidents involving the City of Palmdale, Los Angeles County, Caltrans, or another public entity can also have much shorter deadlines.
- Personal Injury: CCP § 335.1 sets a two-year limit for civil actions arising from injuries caused by someone else’s wrongful act or neglect.
