A woman fainted and was hospitalized after a failed social media challenge in Tustin, Orange County, on Sunday afternoon, March 26, 2023.
According to the Tustin Police Department, the incident occurred at a Target store in Tustin. It involved a group of teenagers tossing a bucket over a stranger’s head and recording their reactions.
Lana M., a new mother of twin boys, was reportedly looking for baby supplies when four teenage boys dropped a bucket over her head and began recording before eventually running out of the shop.
The 30-year-old woman, a cancer survivor, developed epilepsy later in her life, and the assault caused her to faint after being deprived of air. She was taken to UC Irvine Medical Center as the attack left her with physical and psychological effects.
The stunt is believed to be trending on social media platforms such as TikTok. Police are reviewing surveillance footage to identify the teenagers and gathering witness accounts.
Police claimed that, as of this point, they had not found any social media posts about this specific incident.
What to Do After a Premises Liability Accident
Take prompt action to defend your right to financial compensation if you are hurt on someone else’s property. Notifying the property owner as soon as possible after an accident will allow them to start working on your claim for compensation for damages right away. When submitting a formal complaint to the owner, manager, supervisor, etc., you are entitled to a copy of the report.
You should gather relevant evidence at the scene of your injuries if possible. Include photographs of the dangerous area, names and numbers of any witnesses, and a thorough description of your actions during the occurrence. Possessing additional supporting material makes it easier to make your case.
If you wait to see a doctor after getting hurt on someone else’s property, you can have trouble proving that the accident was the cause of your injuries. Getting medical attention is important evidence in a premises liability claim since it increases your chances of recovering from your injuries.
Don’t expect a settlement just because you went to the hospital and filed a report; property owners and their insurers aren’t eager to pay them out until they absolutely have to. Hiring a lawyer who specializes in premises liability can improve your chances of receiving the settlement money you are due.
Premises Liability Accident Lawyers in Orange County
Property owners are responsible for removing any obvious hazards, posting warnings, and making their property safe and secure. If a property owner fails to discover a problem that they reasonably should have, fix a known hazard, or warn of a known hazard, they have breached their duty of care to anybody who enters their property.
Let’s assume the plaintiff has established these criteria and has also shown that the defendant’s breach of the duty of care caused the plaintiff’s damages. Under the idea of premises responsibility, they would have a strong case against the property owner in that situation.
