Best Premises Liability Injury Attorneys for Victims in Merced

If there are any obvious hazards on the property, the owner must address them or provide adequate warnings until they can be fixed. If a property owner fails to discover a hazard that they reasonably should have, fix a known hazard, or warn of a known hazard, they have breached their duty of care to anyone who enters their property.

Supposing the plaintiff establishes these elements and causality (that the defendant’s breach of the duty of care directly caused the plaintiff’s injuries), the defendant would be liable for the plaintiff’s damages. Under the doctrine of premises responsibility, they would have a strong case against the property owner in that situation.
