Encino Motorcycle Accident Lawyers

If you were hurt on Ventura Boulevard, the US-101, or the canyon roads south of Encino, you may have the right to pursue compensation for your medical bills, lost wages, and everything the crash took from you. That right starts with understanding exactly how motorcycle crash claims work in Encino. Local road patterns, split-agency jurisdiction, and neighborhood-specific traffic conditions affect every step.

California Civil Code (CIV) § 1714 places a duty of reasonable care on every driver. When a driver on Balboa Boulevard, White Oak Avenue, or a US-101 on-ramp fails that duty and hits a motorcyclist, the state’s negligence law provides the path to recovery.

Who Can File A Motorcycle Accident Claim In Encino?

Anyone injured by another party’s negligence on Encino roads has the right to pursue a personal injury claim under California law. For motorcycle crashes specifically, that circle is broader than most riders realize:

  • Injured riders are the primary claimants. A rider injured in a left-turn collision on Ventura Boulevard, a merging accident on US-101 near Balboa Boulevard, or a forced stop due to Encino Hills traffic restrictions has standing to file a claim.
  • Passengers on a motorcycle, whether riding on the back or in a sidecar, are direct claimants and are not barred by any fault the rider may share.
  • Pedestrians, bicyclists, and occupants of other vehicles injured in the same crash by the same at-fault driver also have claims. A Ventura Boulevard pedestrian struck when a driver swerved to avoid a motorcycle, for instance, can pursue that driver under the same negligence framework.
  • Surviving family members have rights when a rider is killed. Under California Code of Civil Procedure (CCP) § 377.60, surviving spouses, domestic partners, children, and other qualifying relatives may bring a wrongful death claim.
  • The deceased rider’s estate may file a survival action under CCP § 377.30 to recover damages the rider experienced between the crash and death. The Los Angeles County Superior Court venue serving Encino, the Van Nuys Courthouse East District, is where unlimited civil cases arising from these crashes are usually assigned.
  • Spouses and registered domestic partners of an injured (but living) rider may file a separate loss of consortium claim for the loss of companionship, support, and shared life caused by the rider’s injuries.

Why Motorcycle Crash Claims Work Differently In Encino

Encino lies in the south San Fernando Valley, just north of the Santa Monica Mountains. Mulholland Drive forms its southern boundary, while I-405 forms its eastern boundary. US-101 runs east-west through Encino rather than forming the community’s southern edge. These major roadways, together with Ventura Boulevard and other local arterials, shape how traffic moves through the community and affects motorcyclists here.

The Ventura Freeway / I-405 Merge Environment

US-101 carries high-speed through-traffic across Encino, with interchanges at Hayvenhurst Avenue, Balboa Boulevard, and White Oak Avenue. The I-405 (San Diego Freeway) runs along Encino’s eastern boundary and meets US-101 near the community’s eastern side. Riders entering or leaving these freeways encounter merging and weaving traffic, where differences in vehicle speeds and frequent lane changes can increase the risk of crashes.

Risks Posed By Driveways And Left Turns Along Ventura Boulevard

Ventura Boulevard is a primary commercial arterial running east-west through Encino. Dozens of business driveways open directly into moving lanes along this corridor. That can put riders at risk. For instance, if one driver slows to pull in while another accelerates into the gap, a motorcyclist caught between them has almost no margin for error.

Under California Vehicle Code (CVC) § 21801, a driver turning left must yield to oncoming vehicles that are close enough to constitute a hazard during the turn and must continue yielding until the turn can be made with reasonable safety. Proof that a driver violated this law on Ventura Boulevard, such as surveillance footage from nearby retail establishments, can help support a motorcycle injury claim.

The Encino Hills Traffic Pattern

South of Ventura Boulevard, the Encino Hills road network carries cut-through traffic that Council District 4 (CD4) and the Los Angeles Department of Transportation (LADOT) have identified as a traffic volume and speeding concern. For motorcyclists, these conditions can increase exposure to sudden turns, lane changes, and speed differentials on narrow residential streets.

In response to these traffic concerns, CD4 and LADOT are working with local community groups on a three-phase traffic-calming plan. The first phase, launched in March 2026, includes turn restrictions and no-right-turn-on-red signs, while later phases are intended to address speeding and unsafe driving.

If a crash occurs in this area, evidence about traffic controls, roadway design, driver behavior, and any known safety concerns may become relevant to determining fault and whether a public entity or another party contributed to the collision.

Split Agency Jurisdiction

Where a crash happens in Encino directly determines who holds the official record. The Los Angeles Police Department (LAPD) Valley Traffic Division investigates crashes on Encino surface streets. The California Highway Patrol (CHP) covers freeway segments, including US-101 and I-405. Crashes near on-ramps or interchange areas can generate reports from both agencies.

Building a complete evidence file means knowing which reports to request, from whom, and on what timeline. Requesting an accident report from the wrong agency may waste the limited time you have to pursue compensation for your motorcycle injuries and losses.

Trauma Transport Routes

Riders injured in Encino may receive emergency treatment at hospitals serving the San Fernando Valley, including Providence Cedars-Sinai Tarzana Medical Center, Dignity Health Northridge Hospital Medical Center, and Encino Hospital Medical Center. The destination depends on the rider’s condition and Los Angeles County EMS transport protocols. Riders who meet trauma criteria are generally transported to the designated trauma center for the applicable catchment area. Medical records are maintained by the facility where the rider receives treatment.

Because evidence in Encino is held by different agencies and facilities depending on exactly where the crash occurred, the first question in any claim is who can bring it.

Injuries Encino Motorcycle Riders Sustain In These Crashes

The physical consequences of a motorcycle crash on Encino roads can be significant. Motorcyclists absorb the full impact with no protective frame, no airbag, and no crumple zone. The injuries that follow are not just physically serious. They alter the trajectory of a rider’s work life, financial stability, and independence:

Traumatic Brain Injury (TBI)
A helmet reduces, but cannot eliminate, the risk of a TBI. A sufficient impact force can cause the brain to move within the skull, producing memory disruption, mood changes, cognitive slowing, and, in severe cases, permanent personality change. Many riders with TBIs cannot return to prior employment. Lost earning capacity is a documented, compensable element of the claim.
Lower Extremity Fractures

Femur, tibia, fibula, and ankle fractures are among the most common motorcycle crash injuries. Multiple surgeries, bone grafting, and extended physical therapy are typical. Many riders are left with permanent gait changes or an inability to stand for extended periods, a career-ending limitation for those in physical trades.

Severe Road Rash

High-speed contact with pavement can destroy multiple layers of skin in seconds. These injuries frequently require skin grafting, carry a risk of serious infection, and leave permanent scarring that limits movement and, depending on the location, affects a rider’s ability to return to physical work.

Spinal Cord Injuries

Spinal cord damage can produce partial or complete paralysis, depending on the level of injury. Lifelong personal care assistance, adaptive equipment, and home modifications may all be required. Future-care cost projections form a central component of the damages calculation in these claims.

Crashes involving large commercial vehicles on Ventura Boulevard or the Sepulveda corridor can be among the most destructive. Those claims often involve both motorcycle and Encino truck accident lawyers working together on overlapping evidence.

Complete, continuous medical documentation, beginning at first treatment and covering every exam, imaging study, therapy note, work restriction, and future care recommendation, is what allows an attorney to show insurers and, if needed, a jury, the full scope of harm across all of these injury types. A gap in the record gives the opposing insurer grounds to argue the injuries were not as serious as claimed.

What Damages Can You Recover From A Motorcycle Accident In Encino?

California law allows motorcycle crash victims in Encino to seek compensation for different categories. Each one appears in real California personal injury claims and is relevant when a rider is hurt on Encino roads.

Economic Damages

Economic damages cover financial losses you can document, such as:

Property Damage. The cost to repair or replace your motorcycle, protective gear, and other personal property damaged in the crash is a separate recoverable category with its own three-year statute of limitations under CCP § 338.

Non-Economic Damages

Non-economic damages compensate for harm that is real but has no fixed dollar amount. Examples include:

California has an important insurance-related limit on non-economic damages known as Proposition 213 (CIV § 3333.4). An owner whose involved motorcycle was uninsured, or an operator who cannot establish the required financial responsibility, generally cannot recover pain and suffering or other non-economic damages. Economic damages may still be recoverable. The statute provides an exception for an uninsured owner injured by a driver who is convicted of DUI arising from the crash.

Loss of Consortium. A spouse or registered domestic partner of an injured rider who was not themselves physically injured can file a separate claim for the loss of companionship, affection, support, and the other intangible elements of the marital or domestic partnership relationship that were diminished or destroyed by the rider’s injuries.

Wrongful Death Damages

When a rider is killed, qualifying family members under CCP § 377.60 can seek compensation for lost income and financial support, loss of companionship and guidance, funeral and burial costs, and the value of household services the deceased would have provided. The available damages in a wrongful death action are governed by CCP § 377.61.

Punitive Damages

California courts may award punitive damages when the at-fault driver acted with malice, oppression, fraud, or conscious disregard for the safety of others. Punitive damages exist to punish extreme conduct, not to compensate for specific losses. Courts only award them in a very narrow category of cases.

Insurers routinely make initial offers that do not account for future care costs, diminished earning capacity, or non-economic harm. Knowing the full scope of what your claim can seek is the first step toward not accepting less than you are owed.

How Insurance Coverage Works In Encino Motorcycle Claims

Encino’s roads mix several categories of drivers whose insurance coverage differs significantly. One crash on Ventura Boulevard or the I-405 near Encino can involve a personal vehicle, a rideshare driver mid-trip, a commercial delivery van, or a company car. Each driver’s coverage tier controls how much is available to pay your claim.

In an Encino motorcycle accident claim, you may be able to pursue compensation from one or more of the following:

The At-Fault Driver’s Auto Policy

California raised its minimum auto liability limits under SB 1107 on January 1, 2025: $30,000 per person, $60,000 per crash, and $15,000 for property damage. A serious motorcycle crash involving a TBI, spinal injury, or multiple surgeries can quickly exceed the $30,000 per-person limit.

Uninsured/Underinsured Motorist (UM/UIM) Coverage from Your Own Auto Policy

UM coverage may apply when the at-fault driver has no applicable liability insurance. Encino hit-and-run accident lawyers also check if it’s available in cases where the driver flees the scene and cannot be identified. Meanwhile, UIM coverage may apply when the driver’s bodily injury limits are lower than the injured person’s UIM limits. UIM generally becomes available after the applicable liability limits are exhausted, with payments from liable parties credited against the UIM limit. California does not require drivers to carry UM/UIM coverage, but insurers must offer it, and the insured may reject it in writing.

Rideshare Platform Coverage

If an Uber or Lyft driver causes a crash while the app is active, the platform’s insurance may apply. The available coverage depends on whether the driver was waiting for a ride request, traveling to pick up a passenger, or carrying a passenger to their destination.

Commercial Vehicle and Employer Coverage
If a delivery driver or other employee causes a crash while acting within the scope of employment, their company’s commercial or fleet insurance may provide another source of coverage for the claim.

If a car driver contributed to a motorcycle crash, including in a multi-vehicle collision, our Encino car accident lawyers can help evaluate that driver’s role and the available sources of compensation.

What Happens When You File A Motorcycle Injury Claim In Encino

A motorcycle injury claim in Encino follows a set of steps. How each is handled and how well it is anchored to local evidence directly shape what you can recover:

  1. Immediate Medical Care. Treating your injuries is both medically necessary and legally important. California’s duty to mitigate requires injured parties to take reasonable steps to limit their harm. A gap in treatment, even a short one, gives the opposing insurer grounds to argue the injuries were not serious or were not caused by the crash.
  2. Investigation and Report Collection. An attorney requests the appropriate crash reports based on where the collision occurred (see Split Agency Jurisdiction above for ramp crashes). They typically also send preservation demands to LADOT, to businesses along Ventura Boulevard with cameras facing the scene, and to any owners of vehicles with event data recorder (or “black box”) data.
  3. Ongoing Documentation. Every medical record, imaging study, therapy note, work absence, and prescription generated during recovery builds the damage record. This documentation is the factual foundation of the demand.
  4. Demand and Insurer Negotiation. Once treatment stabilizes, the attorney sends a demand package to the at-fault party’s insurer. The initial offer you receive may be based on an incomplete medical picture that does not account for your future care costs. Accepting an early offer closes the claim permanently, including for injuries that worsen later, so your attorney may negotiate another settlement amount with the insurer.
  5. Litigation, if Necessary. If negotiations fail, the case may proceed to the Los Angeles Superior Court, Van Nuys Courthouse East, located at 6230 Sylmar Ave, Van Nuys, CA 91401, the courthouse serving Encino for unlimited civil personal injury matters in the San Fernando Valley. Legal venues may vary depending on the facts. However, once you file your case, it will likely be resolved through discovery, in which both sides exchange evidence under court supervision before trial. The case may proceed to a judge or jury if both parties cannot settle at this stage.

Who Is Liable For Your Encino Motorcycle Crash?

California’s negligence framework assigns liability to any party whose failure to use reasonable care caused or contributed to your crash, your injuries, and your losses. Under CIV § 1714, that duty runs to every person on the road. In Encino, multiple parties can share fault, and identifying all of them matters because California allows fault to be apportioned across each.

Potentially liable parties for an Encino motorcycle accident include:

Negligent Drivers

The most direct path to liability runs through the at-fault driver. Actions such as speeding, failing to yield to motorcyclists, driving under the influence, and driving while distracted may constitute a breach of the duty of care established by CIV § 1714.

Employers And Commercial Operators

If the driver who caused the crash was on the job at the time, such as a delivery driver or a company employee driving a fleet vehicle on Ventura Boulevard, the employer may be liable under the doctrine of respondeat superior. In other words, they can be held responsible for what an employee does while performing work duties. The employer’s commercial policy and corporate assets may be within scope.

Government Entities

Under Government Code § 835, a public entity may be liable when a dangerous condition on public property causes an injury. Examples include:

  • Potholes or unsafe pavement
  • Broken or malfunctioning traffic signals
  • Missing or damaged signs
  • Dangerous conditions on a freeway ramp

The claimant generally must show that the agency created the dangerous condition or knew, or should have known, about it in time to address it.

Claims involving state highways, such as those maintained by Caltrans, follow the state government claim process. Personal injury claims against the state are generally presented through the California Department of General Services. Claims against local agencies follow a separate claim process. The agency involved depends on where the crash happened:

  • The City of Los Angeles may be responsible for dangerous conditions on city-maintained streets in Encino, including certain roadway and traffic-control issues.
  • Caltrans may share liability for accidents on state highways, including US-101 and I-405.
  • The Los Angeles County Department of Public Works could be at fault for motorcycle crashes on county roads, primarily in unincorporated areas.

Evidence in a public entity claim may include maintenance records, prior complaints, work orders, inspection records, and traffic signal data. See Filing Deadlines below for the special deadlines that apply to government claims.

Vehicle Part Manufacturers

A defective tire, brake component, throttle mechanism, or other failed part can support a product liability claim against the manufacturer. That theory holds the maker responsible for placing a dangerous product in the market, and it runs alongside, not instead of, the negligence claims against any at-fault driver.

California’s Pure Comparative Fault Rule

California follows a pure comparative fault rule in motorcycle accident claims. This means you can still recover compensation even if you were partly responsible for the crash, although your percentage of fault reduces your recovery. For example, if you are found 20% at fault for a crash on US-101 near Hayvenhurst Avenue, you may still recover 80% of your proven damages.

In motorcycle claims, insurers may argue that the rider’s speed, lane position, or other actions contributed to the collision. Lane splitting itself is legal in California when done safely and prudently. However, the circumstances surrounding the maneuver can still be considered when determining fault. Evidence such as witness statements, video footage, vehicle damage, road conditions, and crash reconstruction can help establish what actually caused the collision.

Filing Deadlines For Encino Motorcycle Accident Claims

California law sets mandatory deadlines for pursuing motorcycle injury claims. They typically begin on the date your claim accrued or arose, which is typically the day of the motorcycle crash. Missing any of them typically forfeits your right to recover in court:

  • Personal injury claims: two years from the crash date (CCP § 335.1). This deadline applies to claims against private defendants: individual drivers, vehicle owners, employers, and commercial operators.
  • Property damage claims: three years from the date of damage (CCP § 338). Motorcycle repair or replacement, protective gear, and other damaged personal property follow this longer limit.
  • Government entity claims: six months from the crash date (Government Code § 911.2). If a public entity may be responsible for the crash, you generally must present a government claim within six months of the injury. From here, other deadlines may follow:
    • After a claim is presented, the public entity generally has 45 days to act.
    • If the agency sends a proper written rejection notice, you generally have six months from the date that notice is personally delivered or mailed to file a lawsuit.
    • If no proper written rejection notice was given and the agency did not respond within 45 days, the claim is deemed automatically rejected. The lawsuit deadline is generally two years from when the claim accrued.

Missing the initial six-month deadline does not always end the claim. Government Code § 911.4 generally allows an application to present a late claim within a reasonable time, but no later than one year after the claim accrued. If that request is denied, court relief may still be available under § 946.6.

What Arash Law Has Recovered For Injured Motorcyclists

The results below reflect cases from Arash Law’s motorcycle and related vehicle crash practice across California. Though these cases did not arise in Encino, they illustrate how strong recoveries depend on the way a claim is built and how hard the attorney is willing to push:

$1.55M
Motorcyclist v. Rideshare Company
In July 2021, we secured a settlement for a motorcyclist injured in a collision involving a rideshare company. The recovery was the largest motorcycle accident settlement reported in Tulare County that year.
$1.45M
Motorcyclist v. Construction Contractors
Our client fractured her ribs and sustained head trauma after her motorcycle hit uneven pavement. The contractors responsible for the pavement, as well as the government of the city where the accident occurred, continually denied liability. However, our team was able to settle the case after the first day of trial.
$1M
Motorcyclist v. Trucker
Our client was initially blamed for a motorcycle collision with a truck based on the police report. After investigating the crash, we uncovered evidence showing that the truck driver was actually responsible. We ultimately obtained the full policy limits available for our client.

Past results do not guarantee a similar outcome in any future case. Results depend on the specific facts, injuries, liability evidence, and insurance coverage in each matter.

Frequently Asked Questions About Motorcycle Accidents In Encino

Riders who contact Arash Law after a crash on Ventura Boulevard, the 101, or the canyon roads above Encino often have the same questions. These answers address the legal rules and practical steps that matter most in the first weeks after a crash.

Prioritize preserving the following evidence after your Encino motorcycle accident:

  • Crash Report: Request the report from the agency that responded. Depending on the location, this may be LAPD or CHP. See the Split Agency Jurisdiction section above for more details.
  • Photos and Videos: Photograph the crash scene, vehicle damage, road conditions, traffic signs, and any visible injuries.
  • Witness Information: Get the names and contact information of anyone who saw the collision.
  • Medical Documentation: Keep records of your injuries, treatment, prescriptions, and follow-up care.
  • Surveillance Footage: Nearby businesses may have cameras that captured the crash. An attorney can send a preservation letter requesting that the business retain the footage before it is automatically deleted.

Act quickly when possible. Some evidence, especially surveillance video, may only be available for a limited time.

Possibly. Lane splitting is legal in California (CVC § 21658.1), so the other party can’t say you caused the accident just because you did it leading up to the accident. However, if the insurer argues that the way you were lane splitting contributed to the crash, your share of fault could reduce your compensation. It does not automatically prevent you from recovering damages.

You may have a claim against a public entity if a dangerous road condition contributed to your motorcycle crash. Depending on the location, the responsible agency could be the City of Los Angeles, Caltrans, or Los Angeles County.

Claims against public entities have much shorter deadlines than most personal injury claims. In many cases, a government claim must be presented within six months, so it is important to act quickly.

Yes. Helmets are widely considered to be the best way to prevent serious head injuries during a traffic accident. Additionally, the CVC requires all motorcycle riders and passengers in the state to wear a Department of Transportation-compliant helmet. That means that, though you may still pursue a full claim for all injuries and losses, the defense may raise the following arguments:

  • You share fault because you broke the law.
  • You partially contributed to your head or facial injuries because you weren’t wearing a helmet. In this case, your recovery for all other losses (fractures, road rash, spinal injuries, lost wages, property damage) is not affected by helmet use.

You may still be able to recover compensation after a hit-and-run crash. If the driver cannot be identified, and you have UM coverage as part of your auto policy, you may be able to seek benefits from it. There is a two-year deadline to take certain steps to preserve a UM claim, such as filing the required lawsuit, reaching an agreement with the insurer, or formally starting arbitration. Your case must also meet specific requirements:

  • There must be physical contact with the unknown vehicle.
  • The crash must be reported to the proper law enforcement agency within 24 hours.
  • A sworn statement must be submitted to the insurer within the required 30-day period.

If you do not have UM coverage, you may be able to seek compensation from other sources. For instance, an attorney can help you identify any third parties that may have contributed to the crash, such as a government agency that neglected a malfunctioning stoplight. You may be able to file claims against that entity instead.
