The local shops and open spaces of Sherman Oaks make the city a vibrant yet peaceful community. It’s also close to West Los Angeles, and with lower housing prices, many people are choosing to live in this suburb. But as more people move into the neighborhood, the more crowded the streets and public areas get.

The increase in population, along with other factors, could increase the likelihood of accidents. For example, someone might slip on an uncleaned spill in a restaurant and sustain a hip fracture. Or, a person could contract rabies from a dog bite while at the park.

Situations like these can be grounds for personal injury claims. If you can prove that someone’s carelessness led to the accident that injured you, you may be entitled to receive financial reparations. A personal injury case isn’t easy to win, but our personal injury attorneys in Sherman Oaks can help you get the justice you deserve.

Our eighteen-year-old client was severely injured while working at the Defendant’s farm and using the Defendant’s tractor and harvesting machinery. While our client was stationed on the machinery, the tractor drove into a hole in the ground and it caused the machinery to collapsed on him, crushing his legs. The Defendant refused to accept responsibility and we were forced to arbitrate the case to verdict, in which we won and secured an $18.7 Million award.

Most Common Types Of Personal Injuries

If you’ve told yourself, “I need a personal injury lawyer in Sherman Oaks,” and don’t know where to start, look no further. Our Sherman Oaks lawyers handle personal injury cases that span across different areas, including bodily injuries, birth injuries, dog bite cases, sports injuries, and wrongful deaths.

Here are the most common personal injury cases we handle.

1
Head Injuries

Victims often suffer head injuries in an accident, including facial cuts, chipped teeth, broken jaws, or skull fractures. Facial cuts and chipped teeth can be treated easily, but a broken jaw or skull may require surgery. These injuries can take weeks or months to heal fully.

Other injuries that could appear after an accident are tinnitus and orbital fractures. These ear and eye injuries can also be a symptom of a more serious problem.

2
Brain Injuries

A blow to the head can affect the brain and lead to concussions, hemorrhages, or strokes. In more severe cases, brain injuries could lead to a tumor, aneurysm, or coma.

The common symptoms of a traumatic brain injury (TBI) include headaches, nausea, and blurred vision. These should never be overlooked, as they could lead to more complications if not treated promptly. Make sure to consult a doctor as soon as you experience any of these symptoms after an accident.

Brain injuries take quite some time to heal. Sadly, some cases of brain injuries do not heal at all, leaving victims with a life-long predicament or disability. Either way, treatment is costly and would definitely drain any average person’s bank account. In this situation, you’ll need to make sure that the insurance companies pay you a reasonable settlement. Our personal injury attorneys in Sherman Oaks can help you with that.

3
Back Injuries

Victims often suffer back injuries, such as herniated discs or spondylolisthesis, after a car crash or a slip-and-fall accident. They often require surgery and physical therapy as treatments, which can quickly increase medical expenses.

Back injuries generally take months to heal completely. However, some conditions never fully heal and even lead to a loss of motor function for the victim.

4
Spinal Cord Injuries

When spinal cord injuries occur, victims might partially or completely lose their ability to control movement below the site of injury. Incomplete cases could lead to a partial loss of feeling and movement control, which can take at least six months to heal.

Complete injuries, on the other hand, don’t allow for full recovery. They often lead to permanent paralysis, which has adverse effects on the rest of the victim’s life.

5
Amputations

Some accidents are so severe that they lead to traumatic or surgical amputations. Traumatic amputations happen when a victim’s limbs get torn away in an accident. On the other hand, severe burns or tissue damage can lead to necrosis, therefore requiring surgical amputation of the affected limb.

The loss of limbs, whether it’s one finger or a whole leg, can affect a victim’s quality of life forever. After an amputation, they might never be as capable of working or enjoying their hobbies as much as they used to.

6
Birth Injuries

Congenital disabilities are among the leading causes of infant death in 2021. While one in every 33 babies is born with a congenital disability, some birth injuries are the result of medical malpractice.

A newborn baby’s bones are soft and flexible, which is why they need to be treated with extra care. Otherwise, these babies could suffer fractures, paralysis, or even death. Forced deliveries, improper use of medical equipment, and late C-sections are some of the most common causes of birth injuries.

If you believe you or your newborn has suffered from medical malpractice in Sherman Oaks, our personal injury attorneys can help you file a claim and receive compensation.

7
Dog Bite Injuries

California law states that dog owners are strictly liable if their dog bites someone in a public place. Owners are automatically required by law to compensate a victim for their dog bite injuries, except in some cases. For example, if the victim was trespassing on private property at the time of the accident, the owner could be found free of any liability.

Animal bites often tear a victim’s skin and leave open wounds. If these injuries are not treated properly and promptly, victims may suffer from rabies and eventually die.

8
Sports Injuries

Injuries are common in all types of sports. Among the most common injuries athletes suffer are football head injuries, knee injuries, sprains, joint dislocations, and many more. These injuries take weeks or months of treatment and therapy. Some athletes even lose their ability to play sports altogether.

Protective gear, such as helmets, gloves, or mouthguards, can only do so much. Even with a helmet, you can still suffer brain injuries if a ball hits your face with enough force.

If you were injured due to a teammate, player, or coach’s negligence, you may have grounds to file a personal injury claim.

9
Wrongful Deaths

Many accidents lead to a victim’s death. Some victims die right away due to the impact of the accident, while others die from the injuries they sustain after the event.

If a loved one has died because of someone else’s irresponsibility, the surviving family can file a wrongful death claim. You may reach out to our Sherman Oaks personal injury attorneys regarding this matter. We will do our best to make sure you recover compensation from the at-fault party for your losses and damages, including hospital bills, burial and funeral expenses, pain and emotional suffering, etc.

Accidents That Cause Personal Injuries

Most of our clients are injured victims of traffic accidents, such as the following:

  • Car Accidents – Injuries from these accidents can range from a few scratches from fender-benders to catastrophic injuries from SUV rollovers.
  • Truck Accidents – Collisions involving semi-trucks cause more damage to the occupants of the smaller vehicle. Common truck accidents include rollovers, wide-turn collisions, and jackknife accidents.
  • Rideshare AccidentsUber and Lyft make it more convenient for people to get around. However, rideshare accidents continue to increase as more people use the platform.
  • Motorcycle Accidents – Motorcycles can navigate congested roads more easily than cars or trucks. Unfortunately, motorcycle riders are also more vulnerable due to their lack of protective gear.
  • Bicycle Accidents – Despite the presence of designated bicycle lanes, accidents still occur, especially when other drivers fail to see the cyclist before making a turn or changing lanes.
  • Pedestrian Accidents – Pedestrians don’t have anything to protect them when they’re crossing the street or walking on the side of the road. As such, they often suffer serious injuries after a collision.
  • Uninsured Motorist Accidents – Motorists may not always have insurance or enough coverage to cover the damages in an accident. Our personal injury attorneys have helped many injured victims navigate claims involving uninsured or underinsured motorists.

Traffic accidents are mainly due to driver errors, such as speeding, driving under the influence (DUI), or distracted driving. Other causes include vehicle defects, inclement weather, and roadway issues.

If you sustained injuries or lost a loved one for these reasons, our personal injury attorneys in Sherman Oaks can help you seek justice.

Other Personal Injury Cases We Handle

    • Parking lot accidents
    • Workplace accidents
    • Construction accidents
    • Escalator accidents
    • Elevator accidents
    • Amusement park accidents
    • Daycare accidents
    • Landlord liability for vacation rentals and apartment accidents
  • Product liability, such as injuries sustained from using defective Walmart products

Damages You Can Recover In Personal Injury Cases

Victims of personal injury can claim compensatory damages for their economic and non-economic losses. The court also awards special or punitive damages in cases of gross negligence and oppression, but they’re very rare.

Here are some examples of damages you can claim in personal injury cases:

Insurance companies will always try to pay the least amount of settlement. They will question everything and persuade you to agree to lower compensation. Our Sherman Oaks lawyers, who have successfully worked on personal injury cases, will protect your rights and fight for maximum compensation.

Proving Liability In Personal Injury Claims

Proving the liability of the at-fault party is a significant part of building and winning a strong personal injury claim. Essentially, you will need to prove that their negligence directly led to the accident that injured you.

In any personal injury claim, our Sherman Oaks attorneys will have to prove four elements of negligence:

  • Duty Of Care

A person or entity is legally required to follow a standard of reasonable care to prevent harm to other people. This is called the duty of care. For example, a driver has a duty of care to drive safely. Similarly, employers have a legal obligation to provide a safe working environment.

  • Breach Of Duty

This element means that the person failed to uphold their duty of care and did not act in the same way a reasonable person would in the same situation. A driver would have breached their duty, for instance, if they drove recklessly. Solid evidence, such as CCTV footage, photos of the scene, and data from electronic logging devices, would be required to demonstrate the act of negligence.

  • Causation

Once the two elements above are present, the victim would then have to prove that the breach of duty directly caused or contributed to their injuries or losses.

  • Damages

The last element requires the plaintiff to show proof of damages, such as medical bills, payslips, and invoices related to the injury.

Example Of How Our Lawyers Prove Negligence

In one of our previous cases, a homeless man went inside Walmart, grabbed a baseball bat from one of the shelves, and used it to hit our clients—a man and his wife—shopping in the store.

Brian G. Beecher, Esq. had to establish four things to prove the liability of the homeless man and Walmart. In essence, here’s how our esteemed attorney approached the case:

  1. Both the homeless man and Walmart had a duty to care for the victims. The homeless man had a duty not to attack other shoppers in the store. Walmart, as a property owner, had the duty to make its premises safe for its customers.
  2. Both parties breached their duty. The homeless man breached his duty when he decided to attack the married couple. Walmart breached its duty by not securely storing its baseball bats.
  3. The breach directly caused the incident. The unfortunate incident happened because the homeless man decided to strike the victims, and Walmart failed to store their baseball bats properly.
  4. The incident caused damage to the victims. Because of the incident, the couple suffered serious injuries.

While the accident wasn’t directly the retailer’s fault, the Riverside County jury found that Walmart was 50% liable since the retail chain failed to ensure that the baseball bat was stored securely. As such, Walmart had to pay over $30,000,000 to compensate the victims. In total, Arash Law has secured nearly $50 million in compensation for our client.

The damages awarded to the victims were significantly high because the incident could’ve been prevented if only Walmart had taken action to store the baseball bats securely. After all, it was not the first time people used baseball bats inside Walmart to threaten or harm other people within the premises.

Comparative Negligence In California

California follows pure comparative negligence laws, meaning there can be multiple parties at fault in a personal injury case. As with the example above, the jury assigned fault to both the homeless man and Walmart, as it found that both parties were responsible for the incident to some extent.

Comparative negligence also implies that the negligent parties would only have to pay compensation for the portion of fault they share in the case. For victims, their claims could be reduced if they were found partially liable for the accident.
For example, a pedestrian sues a motorist for $100,000. However, evidence shows that the victim was 30% to blame. In this case, they would only receive $70,000 in compensation.
Unfortunately, the law on comparative negligence also means insurance companies can flip the situation on you and paint you as being at least partially at fault for an accident. Without our skilled Sherman Oaks lawyers for personal injury claims on your side, the other parties could get away with lowballing you.

Statute Of Limitations

The statute of limitations for personal injury claims is typically up to two years from the date of the incident. However, there are many exceptions, including:

  • Getting injured as a minor. The time limit doesn’t start until the victim turns 18. After they turn 18, the two-year statute applies.
  • Filing a claim against a government agency. Victims only have six months from the date of the incident to file a governmental claim. The process is also different.
  • Delayed discovery of injuries. Victims sometimes discover or experience injury symptoms weeks or even months after the accident. In these cases, they have up to two years from the date their injury should have been reasonably discovered.
  • Filing for property damage. Victims have up to three years from the date of the accident if they’re filing a claim for property damage only.

Navigating the deadlines and applicable exceptions can be tricky. Missing them could automatically disqualify your case and cause you to forfeit your right to claim compensation.

If you want to make sure your claim is valid, file it as soon as possible. Our Sherman Oaks personal injury attorneys can help make sure you comply with these legal deadlines.

What To Do After An Incident Of Personal Injury

There are a few things you should remember to do after any instance of personal injury. These aren’t for strict compliance, but you should at least know how to avoid the common mistakes people make after a car accident or other personal injury incidents.

To maximize your chances of winning your claim, here are some things to remember:

  1. Call 911 for emergency medical help. The first thing you should do after an accident is to seek medical attention. Even if you don’t see any injuries or feel any pain in your body, you still need to be examined by medical professionals.
  2. Report the incident to the police. When the police arrive at the scene, they will ask questions about the incident. Recall the details as best as you can, and don’t add anything else other than what you know for sure.
  3. Collect as much evidence as you can. Take photos and videos of the scene, the things that led to your accident, and your injuries. Make sure to get the contact details of the other people involved, as well as possible witnesses.
  4. Speak with Arash Law. Before talking with insurance companies, make sure to consult our personal injury lawyers in Sherman Oaks. We can walk you through what you need to do and discuss your legal options.
