Common Causes Of Wildfires

Wildfires in California occur due to several reasons. Contributing factors may include the following:

Extreme Weather Conditions

The U.S. Environmental Protection Agency (EPA) reported that climate cycles have shifted over the past few decades. These changes, along with rising temperatures, have contributed to a warmer and drier environment. These conditions make the region highly vulnerable to wildfire events.

Human Error And Negligence

Many wildfires in Los Angeles are caused by avoidable actions, such as:

  • Failing to put out cigarettes.
  • Leaving campfires unattended.
  • Malfunctioning machinery that sparks a fire.
  • Engaging in illegal or improper use of fireworks.

Our Castaic wildfire lawyers can help you learn whether you can pursue damages from the individuals who are responsible for the wildfire that affected you. They may collaborate with the fire department and conduct thorough investigations to back claims with credible evidence.

Electrical Line Malfunctions

Electrical line malfunctions are another likely cause of wildfires in Los Angeles and elsewhere in California. When power lines are not properly maintained, they can spark and ignite nearby vegetation. Electrical surges can also cause fires when there is a power outage.

Given the abundance of vegetation in many parts of California, including Castaic, proper management is necessary, especially when high-voltage electrical lines are nearby. Effective vegetation management helps reduce the risk of fires and ensures public safety. Our Castaic wildfire attorneys can investigate your case and work to pursue accountability from the parties who failed to address or prevent electrical line malfunctions.

Liable Parties In Wildfire Cases

Drought, dry weather, and strong winds create the perfect conditions for fires to ignite and spread rapidly in California. While many wildfires are caused by natural forces, human negligence or misconduct is often a contributing factor. Poor forest management, a lack of fire safety measures, and equipment failures can exacerbate these disasters, leaving victims to suffer immense losses.

Liability for wildfire incidents may rest with one or more of the following parties:

  • Utility Companies — These companies may be held liable when poor maintenance (such as overgrown vegetation near power lines) or faulty equipment (like sparking transformers or downed lines) causes the fire. If a company delays necessary upgrades or inspections, it may also be found responsible.
  • Arsonists — Individuals who intentionally start wildfires can be held civilly liable for the destruction they cause.
  • Government Entities — In some cases, inadequate forest management, failure to enforce safety regulations, or delayed emergency response may be grounds for holding these agencies accountable.
  • Individuals — According to the National Park Service, human error causes around 85% of wildfires. Examples include leaving campfires unattended, discarding cigarettes in dry areas, or ignoring fire bans.
  • Water Companies — Water companies may be liable if an inadequate water supply hinders firefighting efforts and exacerbates wildfire damage.
  • Manufacturing Companies — If equipment or machinery malfunctions due to a defect, and this leads to a wildfire, manufacturers may be held responsible.

Wildfire cases are often complex. Investigations may take a while to complete, and there are plenty of factors to consider. If you’ve suffered significant losses, our Castaic wildfire lawyers are here to assist.

How Our Lawyers Prove Liability In Wildfire Cases

Our wildfire attorneys understand how difficult it can be to rebuild your life after incurring losses from these calamities. If you have a valid case, they can work to establish liability and support your claim.

Proving Negligence

Negligence occurs when someone who has a legal obligation to ensure the safety of others fails to meet that responsibility. To establish negligence in a wildfire case, our Castaic wildfire attorneys will seek to prove these four elements:

  • Duty of Care — The person or entity responsible had a duty to observe due care in order to protect you from injury.
  • Breach of Duty — The at-fault party breached their duty and didn’t act the same way a reasonably prudent person should.
  • Causation — The at-fault party’s actions, or lack thereof, directly caused the fire.
  • Damages — You suffered losses due to the fire.
Strict Liability In California Wildfire Claims

Inverse condemnation mandates that entities compensate property owners when their property is damaged or taken for public use, even if the entity causing the damage is not negligent. In California, this doctrine extends to include both publicly owned utilities (POUs) and investor-owned utilities (IOUs), treating them as “public entities.”

Under inverse condemnation, utility companies are subject to strict liability, meaning they can be held liable for wildfire damages caused by their equipment, regardless of whether they acted prudently or adhered to safety regulations.

Insurance Concerns During Wildfires

Navigating wildfire insurance claims can be complex and stressful, especially when there is large-scale damage involved. After the January 2025 wildfires in California, a one-year moratorium was enacted to prevent insurers from canceling or refusing to renew residential policies in designated fire zones. This measure was critical, as many insurance companies dropped policyholders in these areas a few months before the disaster.

Here are some of the other issues wildfire victims may face when dealing with insurance companies:

  • Homeowners discover that their coverage limits are insufficient to rebuild their homes or replace their belongings after a wildfire.
  • High volumes of claims often lead to significant delays in claim approvals and payouts, leaving victims in prolonged financial uncertainty.
  • Insurers may dispute the cause of damage, claiming it was not directly related to the wildfire, or challenge the value of the losses.
  • Temporary living expenses, like hotel stays or rentals, may not be fully covered or may have strict time limits, creating additional hardships for displaced victims.
  • Some victims may struggle to provide detailed inventories and proof of ownership for lost or damaged belongings, which can slow down claim approvals.
  • Disputes over the value of damaged property can arise when insurers’ appraisals differ significantly from those of independent contractors or adjusters.
  • Some insurance companies may face financial instability or even bankruptcy after catastrophic wildfires, jeopardizing payouts for policyholders.
  • Premiums may increase significantly after a wildfire, making insurance less affordable.

Our Castaic wildfire lawyers can provide support to victims navigating the complexities of insurance claims. Some of the processes we can help with include filing claims, challenging unfair denials or underpayments, and pursuing compensation for losses. Call us at (888) 488-1391 to see how you can get started.

Compensation For Wildfire Victims

Our Castaic attorneys understand how overwhelming wildfires can be for the victims. Depending on your situation, you may have the right to seek the following types of damages:

  • Monetary Compensation for Property Damage — If you suffer damage to your home, business, or other structures, you may be entitled to monetary compensation.
  • Reimbursement for Living Expenses — If you’ve had to leave your home, you may be able to get some living expenses reimbursed, like food and shelter.
  • Compensation for Injuries — If you or a loved one sustained injuries, you may seek compensation for medical costs, lost income, and emotional distress in a personal injury claim. This compensation may also pay for treatments such as physical therapy, chiropractic care, or surgery, as long as they are related to the injuries you sustained from the wildfire.
  • Property Damage — These include expenses for home repair or rebuilding. This may also pay for the repair or replacement of vehicles similarly damaged in a wildfire.
  • Business Losses — You may be entitled to seek damages for lost income and disruption to your business operations caused by the wildfire.
  • Personal Property Losses — This may pay for lost belongings in a wildfire.

Steps To Take In Case Of A Wildfire

Wildfires can cause damage not just to your home but to your health as well. That said, consider prioritizing your well-being above everything else. Below are just some actions you can take in case of a wildfire:

Prioritize Your Safety

This step can involve preparing the following:

  • Evacuation Plan — Create an evacuation plan for you and your family. This may include a designated meeting place that each member of the family knows about. A list of emergency contacts and evacuation routes can also be made available for everyone.
  • Emergency Kits — Prepare a wildfire go-bag for everyone in your household. This way, you can quickly leave when needed. Make important documents accessible so you can bring them upon evacuation.
  • Protective Wear — Wear masks and other clothing that can protect you from fire or smoke.

If you received an evacuation order from the appropriate channels, it is best to follow it immediately. Go to the nearest evacuation or shelter site. Once there, assess yourself and your family members. Seek immediate medical attention if you or your family experience shortness of breath, chest tightness, or persistent coughing. These symptoms could be signs of a serious condition that requires prompt care.

Evaluate Property Damage

Once you’re safe, remember that authorities may not lift the evacuation order right away. To prioritize your safety, you might need to stay longer in evacuation centers or temporary housing until the wildfire is under control.

As soon as you receive permission to return to your property, you can start assessing the damage the wildfire has caused. Check the following:

  • Inspect for issues in your gas, water, or power supply. You can also assess walls, ceilings, or support beams for structural issues that may cause serious risks.
  • Check if there are missing or damaged parts of the roof. Look for any leaks or weaker places that may require repair.
  • Assess if your personal belongings incurred smoke, fire, or water damage.

Our Castaic wildfire attorneys are here to help evaluate the damage you’ve suffered. We can work with experienced appraisers and assessors to see if your claim accurately reflects your losses.

Document Your Losses

Take photos and videos of your property damage, including your home, belongings, and surrounding areas. Keep a detailed inventory of lost or damaged items, including receipts or estimated values, if available. If your car was damaged or totally destroyed, our car accident lawyers can also help you explore your options.

In the event of damage to your house, you will need your insurance documents to verify your coverage. If you’ve lost these documents, don’t worry. Your insurer must provide you with a copy upon request.

To check if you have a case and can pursue damages, you can consult our wildfire lawyers in Castaic. If you are not sure whether you have a valid claim, fill out our “Do I Have A Case?” form.

California Wildfires In 2025

A historic series of wildfires, including the Castaic Wildfire, ravaged Los Angeles and other parts of California in 2025. These displaced thousands of residents and resulted in a significant amount of personal losses and property damage. The number of fatalities stands at 29 as of January 27. Some of these wildfires include:

Eaton Canyon Fire

The Eaton Fire, which began at around 6:00 pm on January 7, 2025, in Los Angeles County, has burned over 14,000 acres across Altadena, Pasadena, and Sierra Madre. It has become one of the most destructive fires in California history, causing at least 17 deaths and over 9,000 damaged structures. The cause of the blaze is under investigation, with eyewitnesses claiming electrical equipment was on fire just before it started. Southern California Edison, which operates in the area, has denied involvement.

Pacific Palisades Fire

The Palisades Fire has caused extensive destruction, forcing thousands to evacuate and putting many structures at risk. As of January 21, the Palisades fire claimed 11 lives. The Santa Monica Mountains area has suffered the worst damage since the thick vegetation there provided fuel for the raging fires. Firefighters have issued urgent warnings as the flames have spread rapidly due to factors such as shifting winds and unusually dry weather.

Hurst Fire

The Hurst Fire started on January 7, 2025, in Sylmar, and it grew to almost 800 acres after being fully contained. Southern California Edison reported that a power line had fallen at a tower near the Hurst Fire’s ignition point. The report stated that a relay for a Southern California Edison circuit in Sylmar failed about a minute after the Hurst Fire. The company claims it cannot determine if equipment damage occurred before or after the Hurst Fire began. Investigations into the fire’s cause are ongoing.

Kenneth Fire

The Kenneth Fire broke out in West Hills on January 9, 2025. It grew to over 1,000 acres and was fully contained by January 12, 2025. The fire affected areas in North Los Angeles and Ventura counties. Authorities have identified a person of interest and are investigating whether arson played a role in starting the fire.

Hughes Fire

The Hughes Fire broke out on January 22, 2025, on Lake Hughes Road near Castaic Lake and quickly spread due to dry conditions and high winds. As of January 28, the fire has consumed over 10,000 acres.

Frequently Asked Questions

California wildfires can leave residents grappling with loss and uncertainty. If you’re among them, you can consider exploring your legal options to recover compensation for property damage, injuries, and other losses. To help you navigate this process, we’ve compiled answers to the most common questions about wildfire lawsuits, insurance claims, and your rights as a victim.

Our Castaic wildfire lawyers work on a contingency fee basis. Under this payment arrangement, you don’t have to pay attorney fees up front. You’ll only have to do so if they obtain a settlement or award, and the fee is a pre-agreed percentage of the total payout. Certain case-related expenses might still be incurred regardless of the result, but our lawyers will clarify these to prevent surprises.

It is best to review your insurance policy to check your provider’s deadlines. In California, there is no universal deadline for submitting an insurance claim, since it varies based on the policy and the type of loss. Nevertheless, it is advisable to file a claim promptly after an incident to prevent potential problems.

If you encounter challenges or delays with your claim, consulting experienced Castaic wildfire lawyers can provide clarity and support. Call us at (888) 488-1391 to learn more.

This depends on why you are suing your insurance company. If you are suing your insurance company for bad faith, you have two years to act under California law to pursue legal action. Breach of contract, however, has a four-year time limit in the state.

While pursuing legal action may be necessary in some cases, there are still ways to resolve wildfire cases through out-of-court negotiations. Regardless of the situation, our Castaic wildfire attorneys can represent you in settlement negotiations or litigation.

Yes, renters can file a claim for wildfire damages. While your renter’s insurance policy won’t cover structural property damage, it typically provides coverage for personal belongings lost or damaged in a wildfire. The property owner and their insurance policy are responsible for covering damage to the building itself.

Our Castaic wildfire attorneys can help you assess, calculate, and document your losses. We can help you pursue the full value of your damages in line with the evidence available for your case.

The duration of a lawsuit against a utility company can vary, and there is no set timeline. This type of investigation is likely to take longer than others, especially if there is a need to gather key evidence. The availability of this proof can also affect the timeline. Our Castaic wildfire lawyers can assess your case, provide a clear understanding of your situation, and guide you through how long each step of the process may take, given your circumstances.

Natural catastrophe risks, operating costs, profitability, market circumstances, and the inability to raise insurance rates sufficiently are some of the reasons insurance firms decide to leave California.

California insurance companies can cancel or refuse to renew your policy. They must, however, follow certain standards. It is possible to appeal their decision to terminate or not renew your policy. Our Castaic wildfire attorneys can help you evaluate your legal options if your insurance company drops your policy for unfair reasons.
