Yes, Uber can be sued for a car accident involving an Uber vehicle. However, there are some factors you must consider. One of which is establishing liability.

Liability for an Uber accident can be a somewhat tricky proposition because liability in these cases will often depend on whether an Uber driver was logged into their Uber app and what stage of the process they were involved in. When an Uber driver is not logged into the app or the app is off, it will usually be the Uber driver’s own personal car insurance policy that covers all damages.

If an Uber driver is available on the app or waiting for a ride request, then Uber will maintain auto insurance on a driver’s behalf in the case of a covered accident. The total number of sexual assaults reported across the five categories included in the report went from 5,981 in 2017-2018 to 3,824 in 2019-2020, or a decrease of 38 percent. Non-consensual sexual penetration was reported on about 1 in 5 million trips or about 0.00002 percent; non-consensual kissing of a sexual body part was reported in one in every 5 million completed trips; instances of non-consensual touching of a sexual body part were reported in about one in every 1 million trips; attempted non-consensual sexual penetration was reported in about one in 7 million completed trips; and non-consensual kissing of a non-sexual body part was reported in about one in every 3 million trips.
